BOSTON -- A bizarre case of mistaken identity could cost Middlesex Sheriff's Department officers $65,000 after they arrested a Wilmington woman in her home instead of her twin sister two years ago.
Wilmington resident Janet Silva is on the verge of finalizing a settlement with Middlesex Sheriff James DiPaola and two officers from the department, said Silva's lawyer, David Fried.
The lawsuit charges the sheriff's office with false arrest and imprisonment along with several civil-rights violations for arresting her before dawn in her Wilmington home when in fact it was her twin sister, Janice, they were supposed to pick up.
When Janet Silva tried to tell officers they had the wrong sister, one of the officers said, "We hear that same story every day," according to the lawsuit.
DiPaola argues, through court documents, that the Sheriff's Department isn't at fault because the warrant, issued by the Somerville District Court, had Janet Silva's name on it even though it listed Janice Silva's address in Somerville.

If this had been a LEGIT LE agaency with REAL training, this probably would not have happened. These Correction Officers who served this warrant are boobs and should go back to working a block where they belong. It doesn't take a rocket scientist to confirm a warrant.

Sooooo, is Janice a raging felon on a 3-state crime spree, still at large? Was this a fugitive from justice that needed to be scooped up for the public's safety? Or, was this a case of the SO trying to "clear" some warrant just for stats.

The bottom line is they were faced with a dilemma and no information base to determine fact from fiction.

Playing cop without the tools.
