Guilty verdict in Brockton slaying

BROCKTON— A 22-year-old man was convicted of second degree murder Tuesday in the slaying of a Brockton man during a botched drug deal.

Matthew McKinnon of Brockton was sentenced by Superior Court Judge Charles M. Grabau to the mandatory sentence of life in prison with parole. That means he could be eligible for parole after 15 years.

McKinnon was convicted of fatally shooting Claudy Jean-Poix, 21, on July 17, 2005, during a botched marijuana deal on Winthrop Street.

The jury deliberated nine hours over two days before returning the guilty verdict.

The victim and some friends were delivering marijuana to the suspect when, authorities allege, McKinnon tried to rob him. A struggle ensued and Jean-Poix was shot.

McKinnon fled the city and was arrested in New Bedford a couple of weeks later.

The gun used in the slaying was recovered in New Bedford about six months after the killing.

McKinnon took the stand during the trial, saying the victim was the one who had the gun, defense attorney Francis O'Boy said.

Assistant District Attorney Thomas Flanagan, who prosecuted the case with Courtney Cahill, noted during closing arguments that witnesses said McKinnon pulled out a gun and, as the victim pulled away with his hands up, opened fire.

Josette Theart, the victim's mother, in a statement read by Cahill to the court, said her life has been full of stress since the slaying and urged the judge to send McKinnon to prison for life.

“I think he should get life in prison so he won't be able to kill more people,” Theart said in her statement.
