BROCKTON— Every week for three years, Claire Burdziuk called the district attorney's office.
Keep looking for my son's killer, the Hanson woman would say. Don't give up.
She hopes her search for justice ended Tuesday with the arrest of a 21-year-old Brockton man in the Aug. 23, 2004, shooting death of her son.
“You always hope that call will come,” Burdziuk said. “I didn't even cry. I couldn't stop smiling. It is a good feeling.”
Lewis Franklin of Brockton was arrested Tuesday morning, one day after investigators obtained a warrant charging him with the murder of Burdziuk's son, John Falcone, 30, of Hanson.
Franklin pleaded innocent to a single count of murder during a brief arraignment in Brockton District Court. Judge David Turcotte ordered Franklin held without bail.
Franklin, who was represented by attorney Joseph Krowski for the arraignment, will be back in court on Nov. 14, when another lawyer will be appointed to the case.
Assistant District Attorney Russell Eonas told the court Tuesday that the charges stem from a fatal shooting outside 24 Farrington St. in 2004.
Sources said the shooting came after the suspect sold the victim fake drugs. The victim demanded his money back and was shot, sources said.
Falcone was shot in the chest and pronounced dead at Brockton Hospital about an hour later.
Burdziuk said that at first she called the Plymouth County district attorney's office twice a week, urging officials not to forget about her son's death.
Then she called every Monday — her day off from work.
She talked with victim/witness advocate Mary Glavin. She talked with First Assistant District Attorney Frank Middleton.
“You never get the feeling that you are bothering them,” she said. “They are all very good.”
She made her weekly call on Monday and left a message for Middleton.
“I didn't get him on the phone that day,” Burdziuk said.
She got a call from Glavin on Tuesday instead: A suspect was under arrest.
Burdziuk said she is relieved an arrest was made.
“I visit my son's grave once a week. It is hard to go there and know the person who did it is walking around free,” she said.
