Former riding instructor now facing federal charges
BOSTON -- An equestrian trainer from Swansea, already facing statutory rape and other state charges, is now facing federal charges as well. A spokeswoman for the FBI says Joseph Silva was arrested by U.S. Marshals on charges of production, distribution and possession of child pornography. The 32-year-old Silva is scheduled for an initial appearance Wednesday in U.S. District Court in Boston. In April, a Bristol County Grand Jury returned a 22-count indictment charging the former horseback riding instructor and stable owner with statutory rape, posing a child and possession of child pornography. He was ordered held in home confinement until his trial, which has yet to be scheduled.

New Bedford — Former equestrian trainer and alleged rapist Joseph M. Silva has been indicted by a Bristol County grand jury on several new charges. District Attorney spokesman Gregg Miliote said Silva’s new charges include rape of a child, indecent assault and battery of a child under the age of 14, rape of a child with force, four counts of inducing a person under the age of 18 for sex and two counts of assault and battery with a dangerous weapon. Miliote said a majority of the alleged offenses took place in Berkley between 1995 to 2006; the rape with force alledgedly occurred in Taunton between 1999 and 2003; two of the four charges of inducing a person under the age of 18 for sex are from alleged incidents in Swansea between 1995 and 2006. Silva, 32, of 242 Dillon Lane, is scheduled to be arraigned on the new charges June 19 in New Bedford Superior Court. A grand jury indicted Silva in April 2007 on multiple counts of statutory rape, posing a child in the nude, possession of child pornography and a host of other charges. That October, the U.S. Attorney General charged Silva with a number of federal crimes including production, distribution and possession of child pornography. Silva, a former horseback riding instructor and owner of Silver Falcon Stables in Swansea, was ordered to home confinement by Superior Court Judge Francis McIntrye last May while awaiting trial for the 22-count indictment that included four counts of statutory rape (three from Swansea and one from Berkley); five counts of posing a child in the nude (four from Swansea and one from Berkley); four counts of disseminating harmful material to a child (all from Swansea); two counts of disseminating visual material visual material of a child in the state of nudity (both Swansea); and seven counts of possessing child pornography. He was recently scheduled for a pre-trial hearing on these charges on Sept. 8. Silva wears two electronic monitoring devices, one for the state and one for the federal charges, and was directed to have no electronic devices in his home that could be used to access the Internet or e-mail, no contact with children under the age of 18 or contact with the alleged victims or any former riding students. At last May’s dangerousness hearing, Assistant District Attorney Silvia Rudman said the incidents and charges involved two victims, which took place between 1996 and 2006, but have identified “four and suspect that there are more out there.” Silva had initially been arrested in March 2007 on a total of eight charges which included statutory rape of a child, possession of child pornography and posing a child in the nude and was placed on $100,000 bail.
