Drug Dealer Sentenced For Illegal U.S. Entry

A Worcester man was sentenced today in federal court for being found illegally in the U.S. after his deportation to Jamaica in 2001.

United States Attorney Michael J. Sullivan and Bruce M. Foucart, Special Agent in Charge of the Immigration and Customs Enforcement in New England, announced today that DELROY POWELL, age 49, formerly of 101 Paine Street, Worcester, was sentenced by U.S. District Judge F. Dennis Saylor IV to 46 months’ imprisonment, to be followed by three years of supervised release. POWELL pleaded guilty to Illegal Reentry After Deportation for an Aggravated Felony on July 12, 2007. At the earlier plea hearing, the prosecutor told the Court that had the case proceeded to trial the Government’s evidence would have proven that POWELL was convicted in New York in 1997 of an armed bank robbery. After serving a federal jail sentence for the bank robbery, POWELL was deported to his native Jamaica, where he remained for three years before illegally reentering the United States without the permission of the Attorney General or the Secretary of the Department of Homeland Security.
POWELL was arrested by the West Boylston Police Department in January 2007. At that time, the West Boylston Police had been conducting an investigation into a shipment of 30 pounds of marijuana that originated in California. As part of the investigation, an undercover officer, posing as a courier, delivered the package to a residence in West Boylston to which it had been addressed. Thereafter, a team of officers maintained surveillance of the residence in order to track the package. POWELL arrived at the residence shortly after the controlled delivery, and was arrested by surveillance officers as POWELL and the person in the residence who received the package walked from the residence with the package.
POWELL has been in state custody on drug charges. He was indicted federally when the West Boylston Police Department determined after POWELL’s arrest that POWELL was illegally present in the U.S., and contacted federal immigration officers.
