Suspected drug dealer in Lowe's police shooting remains held

DANVERS - The two Danvers police detectives who opened fire at a suspect they feared was about to run them down weren't alone in the parking lot at a Route 114 home improvement store last June, a prosecutor said yesterday.
State and federal drug investigators were also setting up near Lowe's Home Improvement, waiting for suspected drug dealer Todd Scioli to show up.
Scioli, 35, of Middleton was arraigned yesterday in Salem Superior Court on charges that include assault and battery with a dangerous weapon - his sport utility vehicle, assault and battery on a public employee, and resisting arrest stemming from the June 14 incident.
He's still facing indictment on drug distribution charges stemming from that same investigation that drew local, state and federal law enforcement to the parking lot on a busy late spring evening.
Scioli had been held without bail after initially being charged with two counts of attempted murder on the detectives, Tim Williamson and Robert Sullivan. However, last month a grand jury declined to issue an indictment on that charge.
Because of that, Essex County Assistant District Attorney Jean Curran was limited to asking for cash bail. She asked Salem Superior Court Judge David Lowy to set that bail at $100,000 cash, offering new details about the case.
After Scioli's lawyer, Michael Cioffi, suggested they delay any decision on bail until the grand jury decides whether to indict Scioli on the drug charges, Lowy ordered him held without bail until then.
Curran said Scioli, who listed an address in Middleton, was actually staying in a series of Route 1 motels, dealing drugs out of the rooms and at area parking lots. On the night of his arrest, Williamson and Sullivan spotted Scioli at a gas station and feared that Scioli had recognized them, even though they were in plain clothes and an unmarked car.
As they headed to the Lowe's lot, they saw Scioli approaching them head-on, Curran said.
They approached Scioli's SUV, opened the door and reached in for the key, she told Lowy.
Scioli allegedly threw the car into drive and dragged the officers. Both are still out with injuries.
Then, in a move that has drawn some controversy, the officers opened fire on the SUV. Curran said one round hit Scioli's windshield and landed in the passenger seat. A second round hit the grill of the vehicle and lodged in the radiator. But other bullets flew around the lot, hitting other unoccupied vehicles.

Scioli will remain held without bail until his next court date, Nov. 20.
