Female officer accused agency, former brass of discrimination By Patriot Ledger staff
BOSTON - The MBTA paid $150,000 to settle a lawsuit filed by a female T police officer from Weymouth who said that two former T officials discriminated against her.
Lt. Nancy O’Loughlin filed suit in 2004 after she was suspended and then demoted. The suit was against the agency, former T Police Chief Joseph Carter and former General Manager Michael Mulhern. The case was settled in May the day before trial was scheduled to begin in U.S. District Court in Boston.
Responding to a public records request filed by The Patriot Ledger, T assistant general counsel Mary Logalbo revealed the terms of the settlement. The T paid the 24-year veteran of its police force $150,000, including her legal bills.
O’Loughlin alleged that Carter unfairly disciplined her because she is a woman and that Mulhern falsely told a reporter that she faced criminal accusations.
The MBTA, Carter and Mulhern denied treating O’Loughlin unfairly.
O’Loughlin was among six T police officers suspended by Carter in 2004 for allegedly criticizing him and other T police brass in conversations on a recorded police line. Carter demoted her and a male lieutenant to patrol officers, the only T superior officers ever demoted two levels.
An arbitrator ruled last year that O’Loughlin didn’t deserve such severe punishment under the union contract and ordered her restored to lieutenant with full back pay. She continued her suit but restricted her demand to damages for emotional harm.
