I know the glorious MGL features no statute against posession within a hospital or pharmacy but just wondering if anyone knows of any states that do if any? and does anyone think maybe MA should?

Can you be more specific? I've locked people up inside a hospital for poss. Class A, and B w/intent to distribute. Are you refering to hospital staff, or the local "street pharmacist" who happens to be in the ER with a pocket full of dope?

I also locked up a guy for B+E of an emergency room "code cart" and then charged him with possession of the drugs he stole from the cart even though they were mostly useless to a junkie...

I apologize obvious drugs are illegal no matter where but, Im wondering if any states there are additional penalties to dealing drugs or posession near a hospital much like in MA we have the additional school zone penalty

With the "school zone/playground" statute it is obvious why it was enacted. Where would the public interest be in a Hospital versus any other location?

What are Durgs???

School Zones are mandated by the feds to each state or no federal money for their schools. So I can only assume that all fifty states have some sort of school zone drug laws.

To answer the hospital question there is a law pertaining to providing alcohol and narcotics to patients in hospitals forbidden

MGL Ch 270 sec 5 sale or delivery of liquor to patients in certain hospitals forbidden

This also includes drugs

That's just to keep alcohol and drugs from people who are supposed to be detoxing.
