Teen faces allegation of rape By Julie Manganis Staff writer
DANVERS - A Peabody teen has been charged with raping a 15-year-old girl in her Danvers home Tuesday.
Robert Banks, 18, of 9 Hamilton Road, pleaded not guilty during his arraignment yesterday in Salem District Court, where Judge Dominic Paratore ordered him held over the weekend until an electronic monitoring bracelet can be set up in his home. The judge also set bail at $7,500.
Prosecutor Elizabeth Satelmajer said the girl and her father went to Danvers police Tuesday evening, where she told investigators that a friend brought Banks along to her home for a visit.
While her friend was outside making a cell phone call, she told police, Banks, whom she knew only as "Bobby," forced himself on her and raped her, stopping only when the friend returned to the room.
She told police she repeatedly yelled at him to stop.
Defense lawyer Neil Tassel questioned the girl's account, saying the girl told investigators she had met Banks at a party on Saturday night, a party Tassel said Banks did not attend. He also suggested that she expressed reluctance to cooperate with police initially, and he raised other issues about her credibility.
Tassel said his client, who suffers from a learning disability and anxiety, is worried about missing school because of the charges.
When he is released on bail, Banks will be required to stay away from the girl and from anyone 15 or younger. He'll also be confined to his home other than to attend school or court.
