Former Corrections Officer Charged With Sexual Assault

Man Also Faces Lawsuit From Inmates Alleging Assault

CONCORD, N.H. -- A former prison guard who was fired two years ago after female inmates accused him of sexual assault now faces criminal charges of sexual misconduct.

Darrell Brinkley, 51, of Antrim, N.H., was indicted Thursday in Merrimack County on five counts of aggravated felonious sexual assault, two counts of felonious sexual assault and one count of simple assault. He was also indicted on one misdemeanor count of sexual assault and two counts of indecent exposure.

James Boffetti, a prosecutor with the state attorney general's office, said the charges allege that Brinkley assaulted three female inmates while they were at the prison's secure psychiatric unit.

If convicted of all charges, Brinkley could face more than 60 years in prison.

A lawsuit filed against Brinkley and the state Department of Corrections last year by two female inmates describe the alleged abuse. Boffetti declined to say Thursday whether the two women who are suing Brinkley are among the three women at the center of the criminal charges. Their allegations are similar to those in the indictments.

The women who brought the lawsuit, who have since been released from prison, said they were assaulted between 2003 and 2004 while receiving treatment for mental health concerns.

Prison officials fired Brinkley in May 2005 but have declined to say why. He joined the prison in 2000.

Brinkley is the second prison guard recently charged with sexually assaulting female inmates. Former Sgt. Doug Tower was convicted earlier this year of raping a female inmate at the Shea Farm halfway house in Concord. Tower is serving 20 to 40 years and faces trial on charges involving 12 other inmates.
