Prisoners Use Paperwork To Retaliate Against Judges

U.S. District Judge Sam Sparks is glad he hasn’t tried to buy or sell any property in recent years. If he had, he says, he might have had to wrestle with a series of fraudulent debt claims filed against him by angry prison inmates.
Some of those claims were the subject of a criminal trial earlier this week in Coryell County, Texas. Mycal Antoine Poole, who is incarcerated in a state prison there, was charged with three counts of filing a fraudulent financial document and three counts of retaliation for claims that he filed against Sparks and another federal judge.
The jury ended up sentencing Poole to 20 years on each count. Although those sentences will be served concurrently, Poole will have to finish the 60-year term that landed him in prison before getting credit on the new sentence.
The documents Poole filed, known as Uniform Commercial Code filings, aren’t something most Texans deal with. They are filed when someone strikes a credit agreement that includes collateral. For example, a bank might give startup money to an entrepreneur for a business in exchange for that entrepreneur offering up real estate to secure the loan.
With such an agreement, the bank could make a UCC filing, which would be added to a searchable database. That way, if the entrepreneur went to another bank and tried to obtain more credit based on the same property, the lender would know it was already spoken for.
Poole has, according to reports, taught other prisoners how to use this method to retaliate against others.
