Three Lewiston, Maine police officers are fighting a Federal District Court judge's decison to allow a Norway, Maine man's suit against them to go forward in spite of the fact they had been cleared by state officials in a shooting in their town. A three-judge panel of the 1st U.S. Circuit Court of Appeals in Boston heard arguments last week on the appeal by officers Carly Conley, Eric Syphers and Matthew Vierling. The lawsuit was brought by Vince Berube, who was shot after he used a hammer to damage police cruisers in the police department parking lot. The officers say they acted in self-defense when Berube charged at them with the hammer. An investigation by the state attorney general concluded that use of deadly force was justified. Berube spent weeks in the hospital recovering from his wounds. He pleaded guilty to a felony charge of criminal threatening and was given a suspended four-year prison sentence.
