AGE GAME: After being canned by the Worcester County Sheriff's Office, Kenneth Hannam sued, claiming age discrimination. His argument? That he had done all the work asked of him, and was replaced by someone younger for no reason other than age.
According to a copy of Superior Court Judge John McCann's decision, Guy Glodis's department vehemently disagreed, arguing for a summary judgment (for the case to be thrown out), claiming that, "Hannam was not performing a proportionate share of physical arrests and property seizures, he was difficult to work with, and he was not a team player."
McCann didn't see it quite the same way. In his decision denying summary judgment, McCann wrote, "[Hannam] was a member of a protected class, being over 40 years old. He had received no warnings about his performance and worked overtime when asked to. Finally, he was terminated and replaced by someone 23 years younger than he was." Essentially, McCann ruled that while Glodis's department claimed Hannam had not performed his job at an appropriate level, every claim they made for rightful termination was rebutted by Hannam.
McCann wrote, "The facts presented by Hannam would enable the fact-finder to conclude that he has rebutted the reasons put forth by the defendants for terminating him."
