Delahunt seeks clemency for Mass. Marine convicted of Iraq murder



WASHINGTON -- U.S. Rep. William Delahunt wants clemency for a Marine from Plymouth who is facing 15 years in military prison for the murder of an Iraqi civilian.
Delahunt said Wednesday he recently sent a letter to the Marine general handling the case seeking clemency for Lawrence Hutchins III, who was demoted to private from sergeant after his conviction.
The South Shore congressman says it is a question of fairness since Hutchins is the only member of his squad to be convicted of murder in the case.
"All of his squad members are free and he's facing a 15-year sentence," Delahunt said in a telephone interview with The Associated Press. "It's a fairness issue."
Delahunt said he requested a meeting with Lt. Gen. James Mattis, who is overseeing the case.
A Marine spokesman told The Patriot Ledger of Quincy that it could take as long as several months before Mattis makes a final decision about Hutchins. A telephone message left by AP on Wednesday for a Marine spokesman was not immediately returned.
The congressman said he wants Mattis to take into fuller consideration how Hutchins was operating under harsh combat conditions.
"I've met him," Delahunt said of Hutchins. "This is a good and decent kid who thought he was serving his country. There's a belief that the individual who was executed was an insurgent. These men had been under constant combat conditions. Fear is the common currency of their experience."
Seven Marine squad members and a Navy corpsman were initially charged with murder and kidnapping. Five cut deals with prosecutors and received sentences ranging from one to eight years in prison.
Hutchins is the only one of the eight who remains in prison.
"This is a war where every day there are unseen casualties and Larry Hutchins is one of them," said Delahunt.
The Iraqi civilian was pulled from his Hamdania home and shot in April 2006. An AK-47 and shovel were placed nearby to make him look like an insurgent planting a bomb, according to prosecutors, who cast Hutchins as the mastermind of a kidnap and murder plot.
