West Bridgewater cop cleared

WEST BRIDGEWATER — A police officer who was assigned desk duty after discharging his firearm during a June 25 pursuit of a stolen semi-tractor is back on the beat after a police investigation determined his use of force was justified, police said.

Police Chief Donald Clark said officer Michael Kominsky discharged two rounds from his department-issued Smith & Wesson .40-calliber semiautomatic handgun as officers assisted state police with a rush-hour pursuit on Route 106 of a Brockton man driving a 1996 Kenworth semi-tractor reported stolen from Citywide Transport in Avon.

“The truck was coming at him. He was scared he was going to get run over, so he opened fire at the truck,” Clark said.

“I don't know if the bullets were recovered. I do know the bullets hit the truck,” he said, adding no injuries resulted from the shooting.

Kominsky declined comment.

State Trooper David Lemar arrested Marc Senatus, 35, of 28 Woodvale St., Brockton after East Bridgewater Sgt. Thomas Reed deployed tire deflation devices to stop the semi-tractor on Union Street in that town.

Senatus also forced a woman off the road during the pursuit, forcing her to crash her vehicle into a mailbox, police said.

Clark said it's standard procedure for police to investigate the use of force during enforcement actions.

Senatus, who appeared in Brockton District Court for a July 20 pretrial hearing, was found guilty of receiving a stolen motor vehicle; assault with a dangerous weapon, a motor vehicle; and reckless operation, and was sentenced by Judge Paul Dawley to concurrent terms of 2 1/2 years in the house of correction, with one year to be served.

He had charges of negligent operation and concealing theft of a motor vehicle dismissed; was found guilty of failure to stop for a police officer and placed on probation until July 20, 2009.

He was also found responsible on charges of failure to stop, marked lanes violation and failure to yield.

He is due back in court on Sept. 25 for a determination of restitution, according to the clerk's office.
