SALEM, N.H. -- A woman charged with drunken driving and hitting a Derry police officer with her pickup truck is facing new charges.

Susan Foss was scheduled to appear in court Wednesday for a probable cause hearing on the drunken driving charge, but police said they found Oxycodone and Clozipan in her vehicle. Foss was charged with three felony counts of possession of a controlled drug.

At Wednesday's bail hearing, defense attorney Ted Lothstein said that the pills belonged to Foss' boyfriend, Paul Grace.

"He told me that the medication is his, and he has a prescription for it," Lothstein said. "I would want to call him as a witness, but first I would want him to get his prescription."

But prosecutors said that's not what they think.

"It's the state's belief his testimony will be irrelevant based on the evidence we have," prosecutor Heather Newell said.

Members of the Derry Police Department were in court. Derry Officer Robert Moore was working a traffic detail in Windham, N.H., on July 25 when he was struck by a vehicle. Police said that Foss was driving drunk at the time.

Foss has two previous DWI convictions, and she was out on bail on a charge of driving drunk in Pelham. Newell said that Foss' history means that she should remain in jail on high bail.

The judge ruled that bail should remain at $50,000 cash.

Moore has been released from the hospital and is recovering from his injuries.
