Controversial Toilet Sign Considered Free Speech, Will Remain Posted




BREVARD COUNTY, Fla. -- A controversial "Keep Out" sign created from a toilet seat that a homeowner posted in response to a neighbor's new security cams is protected free speech, according to Brevard County code enforcement.

The homemade toilet sig is hanging in the South Patrick Shores neighborhood along the eastern property line of 439 Aruba Court on Arthur Hendricks' property.

Hendricks said he put up the sign because his neighbor has two security cameras pointed at his property.

"Personally, as long as he has his camera, this one and another one, pointing in our direction, he should be grateful all he is looking at is a toilet seat," Hendricks said.

Neighbor Edward Fleming contacted Brevard County code enforcement Tuesday and was told the sign was protected free speech.

Fleming said he was perplexed over how such a sign could count as protected speech.

Gary Penna, a code enforcement specialist, said the county's ordinances pertain to commercial signs and that county officials have very little control over non-commercial signs people place on their property.
As long it is not vulgar, there is nothing we can do about it," Penna said.
