Milford Officer Appeals Rejected Grievance

Milford, Mass. - A Milford officer has formally appealed an order from Police Chief Thomas O'Loughlin to return to work after suffering a knee injury.

Sgt. Stephen Wagner, who currently handles light office work duties during the day shift, said he has filed an appeal to O'Loughlin's rejection of a grievance filed several weeks ago.

Wagner said the appeal was filed a couple of weeks ago, not long after O'Loughlin rejected the grievance, and is scheduled to go before the Board of Selectmen on Aug. 20.

The hearing will be held in executive session, meaning it will not be open to the public, Wagner said.

The officer declined to comment on specifics of his decision to appeal but said he was "following the advice of the attorneys."

Wagner had been off the job due to injury since February 2006 before he returned to Milford June 14 and began performing light office work during the day.

O'Loughlin could not be reached for comment yesterday but has said previously he ordered Wagner back to work after a doctor hired by the town for an independent evaluation ruled Wagner was able to return to the force.

O'Loughlin has said it is standard practice to monitor injuries of his officers and it's not unusual to have the town act on the recommendation of an independent evaluation.

O'Loughlin has said Wagner, 40, an 18-year veteran, has been sidelined on and off by injuries to both knees, dating back to early 2004. According to information from the town administrator and town treasurer, Wagner's most recent injury in February 2006 has cost the town just over $230,000 in sick leave pay and medical bills.
