In Wareham, alleged Peeping Tom avoids punishment

WAREHAM nThe husband of a woman who allegedly was the victim of a “Peeping Tom” is angry that a court hearing resulted only in an order for the suspect, a town employee, to get counseling.

“This is a cute way for the town to dispose of this quietly,” said Mike Peters, a state trooper and the alleged victim's husband.

Brian Miller, 39, a maintenance worker for the town's sewer department, appeared at a probable cause hearing June 29 at Wareham District Court on a charge of disorderly conduct by violating the town's Peeping Tom bylaw.

According to a police report, Miller was seen by a witness May 10 sitting in the front yard of Mike and Heidi Peters' home with binoculars. When Miller was pulled over by police shortly afterward, police found binoculars in his front seat and Miller admitted he “had a problem and needed help.”

Mike Peters said the court decided not to issue a formal complaint against Miller and he was ordered to undergo counseling.

“Without a complaint issued, there's no public record against Miller. What if he does it again? And who is going to make sure he follows through with counseling? Until I screamed and yelled, they didn't even pull his pistol permit. You think a guy in someone's front yard peeking through windows is OK enough to carry a firearm?” Peters said.

According to the police report, Miller has a permit to carry a pistol.

The court clerk's office would not comment on the hearing, saying it is not public record, nor would the office say who would oversee Miller's counseling order.

Lt. Irving Wallace, present at the hearing, would not comment on whether Miller's permit was taken away. “The status of a license to carry is not a matter of public information, and I cannot comment on the disposition of the case,” said Wallace.

The Peters, who have five young children, said they have a restraining order against Miller.
