Injunction against Samson MFG. June 26, 2007, Boston, Massachusetts.
In a move to further protect Troy Industries, yesterday, Superior Court Justice Ralph D. Gants issued a Permanent Injunction ordering that Samson Manufacturing Corporation is permanently enjoined from "manufacturing or contracting with others to manufacture for sale…", "soliciting, advertising, or accepting orders for sale…", "disclosing to anyone any design drawings…", and "assisting any third party in the design or manufacture…" of the Modular Rail Forend, Forward Handgrip and Scope Mount.
Troy Industries was represented at the hearing by attorneys Christian G. Samito and Sarah K. Willey, both of Donovan Hatem LLP.
"Troy industries is happy that the Court, after hearing all of the evidence and following the jury's mandate, entered the ultimate ruling, that Samson Manufacturing can no longer manufacture and sell the very products that it wrongfully copied from Troy," said Stephen Troy, founder and president of Troy Industries."This ruling ought to send a message to other competitors that seek to copy Troy's products."
Lead trial counsel, Damian LaPlaca added, "This significant jury verdict and injunction reaffirm to companies, their consultants, contractors, and vendors, that confidentiality agreements will be enforced in Massachusetts and that they provide potent protection for commercial relationships. Without the enforcement of legal documents like these, companies could not openly share privileged information without the threat of losing ownership of innovative ideas."
US Patent No. 7,216,451 Issued to Troy Ind. On May 15, 2007 the United States Patent and Trademark Office (USPTO) issued US Patent No. 7,216,451 "Modular Hand Grip and Rail Assembly for Firearms" to Troy Industries, Inc. The patent examiner cited several other patents in examining Troy's claims, including US Patent Nos. 5,343,650 9/1994 Swan; 6,618,976 9/2003 Swan; 6,655,069 12/2003 Kim, and 6,779,288 8/2004 Kim.
