Question
Is it legal to order a Bulletproof Vest online and have it shipped to your house in Massachusetts. I have a freind that is working at Dunbar providing armed atm and he wanted to find out this info so that he isnt breaking any laws.
Couldnt really find any info on it.
thanx

There's no such thing as a bullet proof vest. Show me a vest and I can show you a bullet that will go through it.

Annoying misnomer aside, civilian possession of body armor is not restricted unless it is being worn during commission of a felony. See: http://www.mass.gov/legis/laws/mgl/269-10d.htm

EOD!,

Yes, under 18 U.S.C.A. section 931 which reads as follows:

(a) In general.--Except as provided in subsection (b), it shall be unlawful for a person to purchase, own, or possess body armor, if that person has been convicted of a felony that is--

(1) a crime of violence (as defined in section 16); or

(2) an offense under State law that would constitute a crime of violence under paragraph (1) if it occurred within the special maritime and territorial jurisdiction of the United States.

(b) Affirmative defense.--

(1) In general.--It shall be an affirmative defense under this section that--

(A) the defendant obtained prior written certification from his or her employer that the defendant's purchase, use, or possession of body armor was necessary for the safe performance of lawful business activity; and

(B) the use and possession by the defendant were limited to the course of such performance.

(2) Employer.--In this subsection, the term "employer" means any other individual employed by the defendant's business that supervises defendant's activity. If that defendant has no supervisor, prior written certification is acceptable from any other employee of the business.

Think of it this way:

Serious offense + convicted felon + gun(s) + body armor ....always think of calling someone from the alphabet (ATF, DEA, or FBI).....contrary to popular belief, they won't steal your case and have the ability, time and resources to effectively present the case for prosecution. The best part....upon conviction, sh*tbag goes to Oklahoma or Texas to do the time!

EOD!,

missfire! Sorry!

At some point the feds will rename the Bulletproof Vest Partnership the Body Armor Initiative.

They'd probably have to spend 70,000 on a feasibility study first and check with the environmental groups about any families of "endangered bullet proof vests" living in a pond in Oregon!
