BOSTON - A state appeals court has upheld the conviction of Nicholas Cirignano for stabbing Matthew Nagle, a former Weymouth High School athlete, and leaving him a quadriplegic.
Cirignano’s appeal challenged the adequacy of the evidence and the trial judge’s instructions to the jury as to self-defense and consciousness of guilt.
Cirignano, 25, received a nine-to-10-year state prison sentence in February 2005 after he was convicted of armed assault with intent to kill and assault and battery with a dangerous weapon.
Cirignano was accused of stabbing Nagle and four of Nagle’s friends, all from Weymouth, during a melee that erupted after Fourth of July fireworks at Wessagussett Beach in 2001.
He contended that he had acted in self-defense.
Nagle testified during the trial that he had no memory of being stabbed.
He said he drank a few beers with friends at the fireworks and the next thing he remembered was waking up in Boston Medical Center eight days later and being told he was paralyzed.
Jurors acquitted Cirignano of four additional counts of assault and battery with a dangerous weapon.
None of the other victims was able to identify Cirignano as the man who stabbed them and then fled the scene.
