DERRY, N.H. -- A Derry man was charged with criminal threatening and resisting arrest after he swung a bat at officers responding to his home on a report of an underage drinking party, police said.
Police said they received a call that underage youths were drinking and doing drugs inside John Upton's home on Friday night.
"When we arrived there, we met with a female juvenile who allowed us into the residence," Capt. Vern Thomas said. "We heard some noise in the background indicative of bottles and cans being shuffled around."
Police said they saw no signs of problems, but they said Upton then became violent.
"Mr. Upton approached us from the back of the house with a baseball bat in hand and demanded we leave his residence using some expletives towards us," Thomas said. "He swung a baseball bat towards one of the officers, smashing the table that was between the officer and him."
Thomas said police used an electronic stun gun on Upton to stop him.
Upton's wife, Janice Upton, was arrested last year following a fatal collision in Hampstead, N.H. Prosecutors said she was drunk and speeding when she rammed into two cars in July 2006, killing one person. Janice Upton was sentenced to 10 years in prison.
Police said that the Uptons have middle-school children. John Upton is not facing any charges in connection with a party or underage drinking.
