By Rebecca Starcevic, Enterprise staff writer MIDDLEBORO — A Middleboro couple who allegedly destroyed their barn for insurance money were indicted today, and could face years in prison and thousands of dollars in fines.
In 2005, Gina Driscoll, 39, and Dennis Bell, 34, reported to Liberty Mutual Insurance Co. that a wooden barn at 569 Wareham St. had collapsed, most likely due to strong winds.
Part of their claim included an attempt to recover the value of the barn, about $27,500.
The insurance company received an anonymous tip that the barn had been deliberately destroyed, according to the state Attorney General's office. In response, the Insurance Fraud Bureau of Massachusetts (IFB) investigated.
On April 28, 2006, an eyewitness reported to Middleboro police that Bell, Driscoll's live-in-boyfriend knocked down the barn with a snowplow attached to his pickup truck.
Liberty Mutual denied the claim in February 2006.
Indicted today by a Plymouth County grand jury, Driscoll and Bell are each charged with insurance fraud and conspiracy to commit insurance fraud.
The penalty for insurance fraud includes a state prison sentence of up to five years and fines of $100 to $500. Conspiracy to commit insurance fraud can lead to as much as 21/2 years in jail and fines of as much as $2,000.
Driscoll is also charged with attempted larceny over $250, which can lead to fines or as much as 21/2 years in jail.
Bell is also charged with malicious destruction of property over $250, which is considered a felony if such destruction or injury is willful and malicious. The penalty calls for a prison term of up to 10 years, or a fine of three times the value of the property so destroyed or injured and imprisonment in jail for not more than 21/2 years.
The couple is scheduled to arraigned in superior court on July 17.
