Maryland Officer Accused of On-Duty Rape

SALISBURY -- A 26-year-old Salisbury police officer was indicted Monday on felony rape and burglary charges after allegedly sexually assaulting a woman he had arrested hours before at her house, the Wicomico County State's Attorney said.
Tracy Ross Sparpaglione of Laurel, has been charged with second-degree rape, third- and fourth-degree sex offenses, first- and third-degree burglary, and misconduct in office after he allegedly sexually assaulted a 19-year-old victim May 26 at her Salisbury residence, State's Attorney Davis Ruark said Monday.
"The Salisbury police officer, while on duty, is alleged to have engaged in very serious criminal activity," Ruark said. "Mr. Sparpaglione faces very serious days ahead of him."
Second-degree rape carries a prison sentence of 30 years and first-degree burglary, 20 years, Ruark said.
Salisbury Police Chief Allan Webster said Sparpaglione is "no longer an employee" of the department. He declined to comment further.
Sparpaglione is a January graduate of the entry-level class of the Eastern Shore Criminal Justice Academy at Wor-Wic Community College, according to the college's Web site.
According to court documents, on May 25, Sparpaglione arrested the victim at her residence on charges of second-degree assault after she allegedly struck her mother-in-law in the lip with a half-full water bottle.
In the early morning hours of May 26, Sparpaglione allegedly used "trickery, fraud or subterfuge" to unlawfully gain access to her house, Ruark said. At this point, the alleged rape occurred.
The victim came forward shortly thereafter and has been "very cooperative," the state's attorney said.
Sparpaglione was first suspended pending an initial investigation by the Salisbury Police Department and the Maryland State Police. He was discharged May 30, four days after the allegations surfaced, Ruark said.
"They discharged him about as quickly as they legally, possibly could," Ruark said.
The criminal proceedings against Sparpaglione will be handled like any other case, he said, and the indictment was to be served late Monday.
