I remember a few years ago in SC they were going to execute a guy for MV homicide where he was OUI and killed two people. I believe the Supreme Court said no go and the guy got life, still more than he would have got in MA.

It's funny that this topic came up. This past semester I did a persuasive speech on why we should utilize capital punishment for convicted child rapists. The class reaction was split about 50/50. I thought it was completely appropriate. Surprisingly enough, my college professor thought it might be "too harsh" a punishment for someone who "only" rapes a child

Must have been a few years ago, I don't remember it. Kinda surprised it even got to that point - vehicle homicide or felony DUI both carry substantially lesser penalties. I always thought that DUI causing death should be 2nd degree murder.

In fact, I seem to remember one in CA where they did charge murder - maybe one of our members from L.A. can tell us - I think it was where the Marina Freeway ends at the beach.
