Female Charged With Multiple Assaults on Troopers

A New Hampshire woman finally faces a judge.Police say she did some traffic stop touching.
It actually happened on New Year's day.
Taryn McCarthy, 21, was getting booked for drunk driving when she got a little frisky.
Police say she grabbed an officer's genitals and punched another in the face.
McCarthy's facing five assault charges, as well as a drunk driving charge.
In court earlier this week, a judge told her to move in with her mom and get a job.

PORTSMOUTH, NH— An aspiring model alleged to have grabbed a state trooper’s genitals several times while being booked for driving while intoxicated has filed court motions seeking the presence at trial of persons who administered or analyzed her blood and/or breath tests.

Taryn McCarthy, 21, of 529 Union St., is charged with aggravated driving while under intoxicated, driving while intoxicated and five counts of simple assault. The charges allege she was driving drunk on Route 1 northbound on New Year’s Day, before being stopped by state police.

Through public defender Joseph Prieto, McCarthy is requesting the presence at her trial of the person who took her blood or breath samples, as well as “the certifying scientist who conducted the test.”

Prieto has also filed motions asking the court that any road alleged to be a public way during McCarthy’s trial “be formally proven” as a public way and for her financial affidavit to be sealed from public view.

One of the simple assault charges alleges McCarthy told Trooper Nicholas Cyr she would punch him in the face, then threw a punch, striking another trooper.

A second simple assault charge alleges she grabbed Cyr in the genital area while reading a police form and after being told not to touch him. A third simple assault charge alleges McCarthy grabbed Cyr’s genital area while taking a breath test and again during the same breath test after being told not to touch him.

The fifth simple assault charge alleges McCarthy grabbed the trooper in the genitals a fourth time while being administered a second breath test.

The aggravated driving under the influence and DWI charges allege McCarthy was driving while intoxicated before Breathalyzer tests showed her blood alcohol concentration to be 0.16.

Since her release on $5,000 cash bail, she has been court ordered to live with her mother, observe an 8 p.m. curfew and get a job.

Her trial is scheduled for June 19.

God I hate that crap. Is there really any question that Route 1, a state highway, in Portsmouth is a public way? They are just wasting everyone's time...

PORTSMOUTH — A aspiring model who grabbed a state trooper's genitals and assaulted another officer during a traffic stop on New Year's Day in 2007 will spend 30 days in jail and five months on electronic monitoring with alcohol testing for a probation violation.

Taryn McCarthy, of 529 Union St., has already sent written letters of apology to the two state troopers involved in the incident, and was sentenced in June to pay a $900 fine, as well as 10 days in jail and the loss of her license for 18 months.

McCarthy pleaded guilty in Portsmouth District Court in June to two charges of simple assault and one count of aggravated driving while intoxicated. During a stop at 3:20 a.m. on Jan. 1, McCarthy punched Officer Chris Storm and grabbed Trooper Nicholas Cyr in the genital area repeatedly as he administered a breathalyzer test.

Girl who grabbed officer's groin jailed without bail




PORTSMOUTH — An aspiring model convicted of grabbing a trooper’s genitals while being booked for driving while intoxicated is in jail without bail for violating probation a second time this year.

Taryn McCarthy, 22, of 529 Union St., is scheduled to be video-arraigned Monday on a charge of probation violation alleging she failed a Breathalyzer test in spite of a court order to abstain from alcohol. In a report to the District Court, probation officer Heather Ross said McCarthy has been monitored by an electronic bracelet since her release from jail for a January probation violation conviction and during a recent unannounced visit, blew a .26 on a Breathalyzer test.

In January, McCarthy was sentenced to a month in jail for probation violation after the court found she tested positive for marijuana during a random urine test and was found by Ross at the Brazo bar.

McCarthy pleaded guilty in June 2007 to aggravated driving while intoxicated and two counts of simple assault. The pleas were her admission to driving on Route 1 at 3:20 a.m. New Year’s Day 2007, before being stopped by troopers who administered Breathalyzer tests measuring her blood alcohol concentration at .16.

During the administration of two breath tests, McCarthy told Trooper Nicholas Cyr she would punch him in the face, then threw a punch striking another trooper. McCarthy also admitted to grabbing Cyr in the genital area while reading a police form and after being told not to touch him.

For one assault charge, she was sentenced to six months in the Rockingham County House of Corrections, with all but three days suspended pending her good behavior for two years. For the second simple assault plea, she was given a six-month jail sentence, with all of it suspended pending two years of good behavior. For the aggravated driving while intoxicated conviction, McCarthy was fined $750 and lost her license to drive for 18 months.

She was also court-ordered to write letters of apology to the two arresting troopers and be under the supervision of a probation officer for two years.

The suspended jail sentences can be imposed if she is found guilty of the recent probation violation charge.
