Two New Bedford men held without bail for shooting, assaulting witness

NEW BEDFORD — A Latin Kings gang member who allegedly fired a .44-caliber revolver on Earle Street last week and a man who allegedly assaulted a witness with a metal pipe will be held in jail without bail for 90 days.
In two separate dangerousness hearings Friday, a Third District Court judge agreed with First Assistant District Attorney William McCauley that Juan Figueroa-Pacheco, 24, and Terrill McKissack, 19, both of New Bedford, posed an imminent danger to society and must be incarcerated. Under the dangerousness statute, the District Attorney's Office must be ready to take the men to trial within 90 days.
According to police reports, Mr. Figueroa-Pacheco, a self-identified high-ranking member of the Latin Kings, fired two shots May 4 around 11:50 p.m. in the area of Earle Street and Acushnet Avenue. Police officers responding to the scene arrested him and found two .44-caliber bullets in his pocket. Police said he tossed a loaded .44-caliber Super Black Hawk handgun onto the street as officers arrived.
Mr. Figueroa-Pacheco is charged with carrying a firearm without a license, possession of ammunition, carrying a dangerous weapon, disturbing the peace and discharging a firearm within 500 feet of a building.
Mr. McKissack is accused of assaulting a 19-year-old male witness to shooting who spoke with police. Along with three men, Mr. McKissack allegedly confronted the witness while he was walking home on Sawyer Street. Mr. McKissack allegedly told the victim, "This is for snitching," then hit him in the face with a metal pipe. The victim suffered a broken jaw and was transported to two hospitals for major facial surgery.
Mr. McKissack is charged with assault and battery with a dangerous weapon and witness intimidation.
Police arrested a second suspect this week in the witness beating case. Alex Perez, 20, of Fitchburg is charged with assault and battery with a dangerous weapon and witness intimidation. He is being detained for a dangerousness hearing Wednesday.
Since C. Samuel Sutter was elected Bristol County district attorney, his office has held 27 dangerousness hearings. The two hearings Friday make it 24 of 26 hearings that the District Attorney's Office has argued successfully. There is one case pending in Attleboro District Court.
Mr. Sutter said he assigned his first assistant to the cases Friday because of their egregiousness. He said witness intimidation will not be tolerated in Bristol County.
"The message will consistently be sent out loudly and clearly by our use of the dangerousness statute and our swift and firm prosecution of these kinds of cases," he said.
