A 28-YEAR-OLD woman who was caught having sex with a teenage neighbour has avoided jail after a judge dismissed the drunken episode as a "foolish lapse".
Melbourne's County Court was told the 15-year-old boy telephoned Diana Nicole Bennett one summer morning two years ago asking her over to his house. Despite having previously knocked back the boy's approaches, Bennett, who the court heard was still drunk from the night before, took the bait. Dressed in underwear and a cardigan, she went to the boy's house in suburban Melbourne where the pair, who had known each other for about six months, had sex in his bedroom. They were caught by a friend of the boy, who walked into the room while they were having sex. The court was told Bennett, who pleaded guilty and faced a 10-year jail term, had an alcohol problem that had played a role in her offending. County Court judge Lance Pilgrim suspended her sentence. Heput down her offending to a lapse in judgment and noted her good prospects of rehabilitation. "I have no difficulty categorising your offence as a foolish lapse," he said.
Had it been a guy with a 15 year old girl, he'd of been labled a "preditor" and been all done with! What an ass clown this judge is.
