Owner appeals pit bull puppy's death sentence
By Steve Landwehr
Staff writer

IPSWICH - The owner of a pit bull involved in the deadly attack on a family pet has appealed the selectmen's order that his dog be euthanized.
Michael Stelline Jr. of Beverly filed the appeal in Ipswich District Court in Newburyport, but a hearing date has not been set.
Stelline followed through with the selectmen's decision that his other dog, Sonny B, be euthanized, but contends Nemesis, an 8-month-old pit bull, did not take part in the attack and should be set free.
The two dogs entered the yard where Sharon French and her sister, Donna Saulnier, were watching their grandchildren play at about 1 p.m. on July 10. At a selectmen's hearing on Aug. 16, both women testified that the two dogs ripped Dolly Parton, their 12-year-old Welsh corgi-cocker spaniel mix, from Saulnier's arms and that Sonny B tore Dolly's throat out.
They further testified that Nemesis had Dolly by her hind legs and was tearing at them.
Animal Control Officer Matt Antczak recommended both dogs be put down, and the selectmen agreed unanimously. Stelline had 10 days to appeal that order.

Man mauled to death at Ving Rhames' home

LOS ANGELES, California (AP) -- A 40-year-old man was mauled to death by as many as four dogs at the home of Ving Rhames on Friday, authorities said.
The victim, who hasn't been identified, had worked at the actor's home for about two years and was responsible for caring for the dogs, said Los Angeles Police officer Sandra Gonzalez.
Four mastiffs were seized by animal services, she said.
Police got a call at 7:15 a.m. from someone reporting a dead body at the home. Gonzalez didn't know who made the call.
The victim was found on the front lawn, she said.
Rhames, 46, who appeared in "Pulp Fiction" and the "Mission: Impossible" series of films, wasn't at home when the attack occurred, she said.

Evidently he died of a heart attack and the dog bites were incidental after the fact. Sort of like that lady who had half her faced chewed off by her dog when she went into a seizure or something.

Colorado Man Accused of Killing Pit Bull in Dog Park Scuffle

MyFoxColorado.com

A Colorado dog owner accuses another man of killing his pit bull after their dogs scuffled at a park, according to the MyFoxColorado.com.
Animal control officers are investigating the death of 3-year-old Mac, a pooch that Ben Johnson said was a model canine for a breed often associated with its brutality.

Click here to read video report on MyFoxColorado.com

Johnson said the incident happened while he was walking Mac at a Broomfield, Colo., dog park when he got into a fight with a Doberman Pinscher. While he and a bystander worked to pull the dogs apart, Johnson said the Doberman's owner pulled a knife and slit Mac's throat twice.
Authorities say the alleged assailant faces animal cruelty charges and the district attorney is slated to make a decision on filing them soon.

As a certified K9 Trainer and Instructor, it pains me to hear that the city or town would consider implementing such a bi law that would prohibit specific breeds within the town. As a trainer who has trained hundreds of dogs I would strongly state that most “issues” that come before me are owner initiated. With proper training and discipline, any dog can be a well-mannered member of society. Owners who fail to properly train and obey leash/ noise regulations are the menace to the town not the dogs. Breed specific regulations are not the solution. Stricter monetary sanctions for owners who act irresponsible are.

I'm sure that will be great comfort to the people who have been mauled by pit bulls, or to the families of those who have been killed by them.

Posted by: NewEngland2007

I agree with you on the owner influence/problem causing, but there are dogs that just aren't going to make it due to basic issues of temperment. With pits, there's an intinct to fight that's bred into them and that makes them a poor choice for a family pet. Having said that, the meanest dog I personally have ever seen was a cocker spaniel that was euthanized after his third bad bite on a child.

The big thing is that most Cocker Spaniel bites can be treated with some Bactine and a band-aid. Assuming the victim survives, a pit bull attack usually requires reconstructive surgery.

I've never gotten a good answer when I've asked pit bull apologists why they insist on endangering their family, friends, & neighbors when there are so many good non-aggressive breeds out there.

Two dead pit bulls found in city

By Brian Fraga
Standard-Times staff writer
August 06, 2007 6:00 AM
NEW BEDFORD — Two pit bulls, both with injuries consistent with dogfighting, were found dead in city waters over the weekend, raising the suspicions of animal control officers who are investigating a suspected local dogfighting ring.
On Saturday afternoon, a male pit bull, wrapped inside a plastic bag, turned up on West Beach in the South End. Animal control officers removed the dog from the waters near the boat ramp on West Rodney French Boulevard. The dog had scratch marks and facial puncture wounds likely caused from another dog biting it, animal control officer Mary Ellen Barlow said.
"The dog had been dead within a 24-hour span," Officer Barlow said. "Its facial wounds, the punctures, are all consistent with dogfighting."
Animal control officers were notified Sunday night of another dead pit bull. The dog's bloated body, was found floating in the Popes Island Marina around 7:30 p.m. by John Curley, a Whaling City Launch Service employee who conducts tours of New Bedford Harbor.
"I noted a peculiar smell," Mr. Curley said. "I glanced over, and I just saw this dog there."
The dog's right ear was torn off, and its stomach badly bruised and cut. Officials said it appeared the dog had been in the water longer than the dog found Saturday.

Organized dog fights are found in Mass.

Officials say operation secretive, small-scale

By April Yee, Globe Correspondent | August 7, 2007

NEW BEDFORD -- The first scarred body of a pit bull was found Saturday, floating off a beach popular with fishermen. The next day, the second pit bull drifted into the marina, its body skin-pink and bloated.
Authorities and animal rescue officers say the animals' injuries were consistent with dog fighting, confirming that the brutal activity is taking place in the Bay State.
The deaths may be linked to an underground, informal network of small-scale dog fighting that stretches across state lines, said Christopher J. Charbonneau, a humane officer with the Animal Rescue League of Boston who is working on the case. In such networks, he said, owners are more concerned about winning street credibility than large sums of money.
"It's so clandestine," Charbonneau said yesterday, standing near where the first dog was found off West Beach in the city's South End. Usually, he said, all that investigators find is the body of a dog that has outlived its profitability or has served as bait for other dogs to practice fighting.

Court frees pit bull involved in death of family pet
By Steve Landwehr
Staff writer

IPSWICH - A clerk magistrate ruled yesterday that selectmen had "questionable jurisdiction" when they ordered the death of a pit bull involved in a deadly attack on a family pet last month, and the magistrate set the dog free.
Town Manager Robert Markel told selectmen of the decision at the start of the board's regular meeting last night. Markel said the magistrate ruled that because Nemesis, an 8-month-old pit bull owned by Michael Stelline Jr. of Beverly, is no longer in Ipswich and wasn't customarily kept in Ipswich at the time of the attack, the euthanization order should be stayed.
The dog has been kept at a kennel in Rowley until the appeal was heard in Ipswich District Court in Newburyport.
Stelline will have to muzzle Nemesis whenever she is off his property and provide training for her, but if she has a clean record for the next year, the death sentence will be dropped.
Stelline's other pit bull, Sonny B, 71/2, raced into a yard on Safford Street on July 10 and killed a 12-year-old Welsh corgi-cocker spaniel mix belonging to Sharon French and her family.
French and her sister, Donna Saulnier, who lives in the same house, testified that Sonny B snatched their dog, Dolly Parton, from Saulnier's arms and ripped her throat out. They further said Nemesis had Dolly by the hind legs during the attack.
At the selectmen's hearing on the incident on July 23, Ipswich Animal Control Officer Matt Antczak recommended both Sonny B and Nemesis be put down, and the board unanimously agreed.
Stelline went along with the ruling on Sonny B and had him euthanized the following morning, but he appealed Nemesis' sentence. Some selectmen were perplexed by the court ruling.
"I'm confused," Selectman Jim Foley said. "The offense occurred in Ipswich and the clerk questions the town's jurisdiction? If this happens in the future, is it a waste of this board's time? Should it just go right to the clerk magistrate?"
Selectman Ed Rauscher was less concerned.
"For the purposes of how we act in the future, we should ignore the magistrate's ruling," he said, adding that, like all rulings, it represents an interpretation of the law.
Chairwoman Elizabeth Kilcoyne also said she believed the board had done everything by the book.
Rauscher wondered if the board might have the authority to ban Nemesis from town, since Stelline had both dogs at an acquaintance's shop on Safford Street on several occasions before the attack, and there was no way of knowing whether he would bring the dog back.

Selectman Pat McNally suggested legal advice be sought, since a public hearing may have to be held to ban the dog.
It was unclear last night whether the magistrate's ruling left Stelline any recourse concerning Sonny B's fate. While he agreed to euthanize the dog, he did so only after the selectmen ordered it. If he had appealed, the magistrate may have stayed that order, as well.

Police Claim Self-Defense In Dog Shooting

Friday, Aug 10, 2007 - 06:04 PM

A Woonsocket police officer shot and killed a pit bull in self-defense, the chief said Friday.

Police said they were called to a domestic dispute when Michael Gelinas started yelling at them, even though they said he could leave the area.

According to police, Gelinas put up a fight when they tried to arrest him and that his put bull bit an officer's leg.

Another officer, Justin Glode, fired at the pit bull, and said he thought the dog was going to attack again.

"(It was) clear cut, clear cut self-defense," Woonsocket Police Chief Michael House said. "I've read all the reports. It is my opinion at this point in time that the individual, Mr. Gelinas, the defendant, had the opportunity to leave the area and chose not to do so."

Police said Gelinas used the dog as a weapon, intentionally letting out its leash.

Like I have said before, I am not a fan of pitbulls ( sorry Kate) but my question is, if they ban pits, whats gonna stop em from banning, shepherd's, rottis, dalmatians, cocker spaniels, pomeranians, pugs, etc etc.

Its like a gun ban, once they politicians start banning stuff, they arent going to stop with just one.

You're comparing apples to moonrocks.....inanimate objects to living beings with certain characteristics inbred into their makeup.

When I see stories nearly every day of Cocker Spaniels and Pomeranians seriously maiming and killing people, I'll be all for banning them also.

Posted by: screamineagle

so you believe everything you read? I am not disagreeing with you delta, I am just saying I have a problem with politicians taking more and more right away from us. Why dont they start going after the owners of nasty dogs, any breed, in stead of banning them? I have a pure bred east german shepherd, the were bred to patrol the wall. He is very protective of me and my family, but is not vicious. He has never bitten anyone. Should he be banned because german shepherds are bred to be a protection dog, its in their nature?

Believe me, if any dog, mine included, goes after me, my family, or anyone else while I am around I will be the first to perforate the with a assload of lead.

Once again....apples and moonrocks. There is a HUGE difference between protective and aggressive.

Posted by: screamineagle

but not all pits are bred to be aggressive. Thats all I am trying to say. Its like saying all dobermans are bred to be attack dogs. And once again, I am no fan of pit bulls.

It's in their genetic coding. It may be suppressed in some dogs, but you can bet your ass it's there. When and where it comes out is a gamble I'm not willing to take.

Man Charged In Strange Case Of Animal Cruelty

Woman Says Estranged Boyfriend Struck Dog With Pipe

NEW BEDFORD, Mass. -- A New Bedford man is facing charges in a bizarre case of animal cruelty.

New Bedford police said a woman was walking with her pit bull Tuesday on Mill Street when her estranged boyfriend pulled up to her in his truck, jumped out, and struck the dog in the head with a metal pipe.

Brentwood Knowles, 35, fled the scene, but was arrested a short time later and charged with cruelty to animals.
Authorities say the dog was on a leash and properly licensed.

The pit bull was taken to a local veterinary clinic and is expected to recover.

Lieutenant Jeffery Silva says Knowles was arraigned in New Bedford District Court Wednesday and released on personal recognizance.

Let's use pit bull apologist logic to explain this sudden, unprovoked violent attack;

"It's not Knowles' fault, it's all in how he was raised!!! There is no such thing as a bad human, just bad parents!!!!"

On the same note one could argue that the woman and dog mercilessly provoked the assault simply by walking down the street!

Dog Stabbed In Skull Will Survive

POSTED: 12:27 pm EDT August 15, 2007
UPDATED: 6:26 pm EDT August 15, 2007

ATLANTA -- A pit bull was rushed to the Atlanta Humane Society Wednesday, with a knife in its skull.

Pit bulls often have a bad reputation as being aggressive dogs, but Mama, the injured dog, is very sweet, said the dog's owner.

Mama's owner found the injured pit bull in the front yard of his southwest Atlanta home with the knife protruding out of her head.

The owner rushed Mama to the Atlanta Humane Society in midtown, and turned custody of the dog over to the agency.

Humane Society workers took X-rays of the dog, which clearly show the blade of the knife embedded in the dog's skull, stopping just short of her brain.

The owner told workers he did not know how the knife got into the Mama's skull.

"I've seen my share of cruelty cases, but nothing like this," said worker P.J. Smith.

X-ray pictures show the knife was clearly embedded in the dog's skull.

But the story appears to have a happy ending.

Dr. Paula Murray performed surgey on Mama to get the blade out. Within minutes after the operation, Mama was up and alert.

"We were finally able to get it out, which is good," Murray said. "We kind of feel like most of it is just in the bone and maybe in the sinuses."

Mama is now in stable condition recovering at the clinic.

Workers said she will survive the injury.

"On a scale of 1 to 10, I would say she's 10 on the scale of being lucky," Murray said. "There is the possibility of swelling, but hopeful we'll be able to combat that and she'll do OK."

Humane workers said that Mama doesn't seem to know what happened or how she wound up at the clinic. They said they hope she never remembers.

Now, the knife is a key piece of evidence as investigators search for the person who stabbed the dog.

The Humane Society is offering a $1,000 reward for information.

"If anyone knows anything about this we just hope that they come forward," Murray said. "Whoever inflicted this horrible act on this poor helpless animal hopefully they'll be caught."

Is Michael Vick in Atlanta right now? Maybe this is the one that got away.
But yeah great dog owner...I left my dog outside, unattended, so much so that someone could come up and stab it in the eye...and I didn't see a thing.
Typical pitbull owner...not really watching the dog.

Pit bull kills seven-year-old in Minneapolis Home

BY MARA H. GOTTFRIED AND EMILY GURNON
Pioneer Press

Article Last Updated: 08/17/2007 11:11:35 PM CDT

Zack King Jr., a 7-year-old Minneapolis boy, is dead after being attacked by his family's pit bull in Minneapolis, according to Lt. Amelia Huffman of the Minneapolis Police Department. (Photo courtesy WCCO-TV)

A 7-year-old boy was attacked and killed by a pit bull in his Minneapolis home today, police said.
The dog had bit people twice in the past, said Minneapolis spokesman Matt Laible.
An animal control manager who has worked for Minneapolis for 17 years doesn't recall any other fatal dog attacks in that period, Laible said.
The male dog, named Face, was tied to a post in a basement at 3530 Humboldt Ave. N. when he attacked the boy, Zachary King, shortly after 1 p.m., said Minneapolis police Lt. Amelia Huffman. Zachary had severe bites to his throat area, she said.
The boy's father, also named Zachary King, tried to intervene and the dog bit him in the arm, Huffman said. The elder King then shot and killed the dog.
The father and son were taken to North Memorial Medical Center in Robbinsdale, where the younger King was pronounced dead, Huffman said.
The father, 30, was treated and released from North Memorial, a hospital spokeswoman said.
Police haven't determined what caused the attack.
Animal control officers removed a female pit bull and five puppies from the home afterward, Laible said.
In 2005, Face bit a trespasser on the family's property, but because of the circumstances it was considered a "provoked bite" and didn't lead to action from the city, Laible said. In 2006, Face left the family's yard and bit a man, Laible said. That bite was considered minor. The city's animal control department .
officially notified the dog's owner that any further incidents could lead to the dog being declared dangerous, Laible said.

A Minnesota Health Department study published in July found the number of people seeking treatment for dog bites in the state increased by 40 percent from 1998 to 2005.
The report also showed:
-- Children ages 1 to 4 were most often bitten.
-- Victims were familiar with the dogs in the majority of cases.
-- Bites occurred most often in the home (48 percent) and the yard (18 percent). -- Attacks happened more often during the summer.

Amen, the dog previously bit two people now bites (and kills) a third person- WTF is the big mystery? The selfish/clueless father should be brought up on manslaughter for allowing that savage animal to remain in the same home as his 9 year old son.

Pit bull attacks two at Arlington home
By Herald staff
Monday, August 20, 2007 - Updated: 04:00 AM EST

Authorities were called to 37 Brooks Ave. in Arlington about 7:30 p.m. last night after two residents were attacked by a pit bull.

According to Arlington police, the owner of the pit bull had to pry open the dog’s mouth from a woman’s leg.

A 32-year-old woman was transported to Massachusetts General Hospital with serious injuries. A 28-year-old man, the owner of the dog, was bitten but sustained non-life-theatening injuries “trying to free the dog from the woman,” police said.

Pit bull still in East Bridgewater

By Alice Judge, Enterprise correspondent
EAST BRIDGEWATER— Selectmen learned Tuesday that a dog that had been ordered out of town earlier in the summer remains in town, and the board voted to give the police chief the authority to seize it.

Chance, a 3-year-old pit bull owned by Crystal Manni of 37 Old Bedford Road, was ordered out of town in June by selectmen and Police Chief John Cowan, and if the dog was found in town, it would be seized.

On Sunday, Donna Leach was walking her leashed dog on Old Bedford Road when Chance pushed at a front window screen at his home and nearly got out of the house. When police were called, the pit bull reacted in the same manner.

Varnell DelVecchio of Old Bedford Road, who bought her house in late July, said she had heard about Chance, but the newspaper articles stated the dog had been ordered out of town.

“We felt safe,” said DelVecchio, who has two boys, Cole, 3, and Philip, 8 months. “Now I'm worried just like my neighbors.”

Cowan talked with residents of Old Bedford Road on Tuesday and was told that every time the dog is seen, it is taken away before the dog can be seized.

Cowan told the residents that since June the animal control officer has made several unannounced visits to 37 Old Bedford Road to check for the dog.

However, when police saw the dog on Sunday they could not reach Animal Control Officer Donna Morris, and Cowan could not force his way into the house to get the dog.

Selectmen unanimously voted Tuesday to give Cowan the authority to seize the pit bull.

Cowan said he will contact District Attorney Timothy Cruz and ask what the next course of action should be.

“If the court says we can seize the dog, then we will go with contempt charges,” said Cowan.

“We tried to work with (the owners). They didn't follow through,” said Cowan.

Woman Mauled in Her Home by Invading Pitbulls

August 22, 2007 2:16 p.m.
PURDY, WASHINGTON (NBC) In what deputies describe as the worst mauling they've ever seen, two pit bulls entered a western Washington state home through an open patio door and attacked a woman in her bed.
Pierce County Sheriff's Dept. spokesman Ed Troyer said a neighbor's Jack Russell terrier also entered a second home in the town of Purdy through the dog door and the pit bulls attacked the terrier named Romeo.
The blood splattered though out Sue Ann Gorman's home tells the story of how she fought off the two pit bulls.
The 59-year-old was in bed, in her room.
Neighbors say she was sound asleep when the attack happened.
She managed to get away, run to her car, lock herself in and call 911.
Even after fighting off the dogs, she was in pretty bad shape.
"Tears into her hands and arms and into her breast and face," said Gorman's friend Carol Southworth.

"Pretty much from head-to-toe, she was covered in blood," said Pierce County Animal Control officer Brian Bowman.
Troyer said firefighters locked the pit bulls in the house until deputies arrived.
Officers had to use pepper spray and fight the dogs to get them into custody.

"I can just say I'm sorry because I can't take it back," said Zack Martin, one of the dogs' owners.
He says the other dog belongs to a friend.
Martin says one of the dogs chewed on a rope holding up the fence to his backyard, and that's how the dogs escaped.
"I would never think my dog would do something like that," said Martin.

Gorman was taken to a local hospital, where she is being treated.
The terrier was taken to an animal hospital, where he died Tuesday afternoon.

Pitt bull in attack is euthanized

Dog seriously hurt girlfriend of owner

By Elizabeth Ratto, Globe Correspondent | August 23, 2007
The 3-year-old pit bull that attacked and seriously injured an Arlington woman Sunday as she reached to pick up her young daughter, was euthanized yesterday, said Arlington Police Chief Frederick Ryan.
The dog, Marley, was put down with the consent of his owner and under supervision of the Arlington Department of Health and Human Services, Ryan said. The dog's remains will be sent to the Department of Public Health to be tested for rabies, officials said.
The victim, Sandra Desalvo, 32, and her boyfriend and the owner of the dog, Peter Siracusa, 28, were watching a movie Sunday at their Brooks Avenue home when Desalvo's daughter began fussing in her crib, police said.
When Desalvo reached for the 2-year-old child, the dog attacked her, biting her arms and hands. The dog had no history of acting violently, and the attack was random, Ryan said.
Desalvo remained hospitalized with serious injuries last night at Massachusetts General Hospital, where her condition was not available.
After the attack, the couple was taken to Mount Auburn Hospital in Cambridge, where Siracusa was treated and released. Desalvo was later transferred to Mass. General. Her daughter was not hurt.
"This was an unprovoked and vicious attack that was further complicated by the fact that there is no record of the dog having received the necessary vaccinations," Ryan said in a statement.
He said police were investigating to determine "what, if any, animal control laws were violated."
Arlington police, who had responded about 7:30 that evening to several 911 calls from neighbors who heard Desalvo scream, contained the dog until animal control officers arrived to remove the dog and take him to the Arlington dog pound, where he remained until euthanized.
Pit bulls have become the most vilified breed of dog in recent years given an increase in attacks against people. In 2000, the US Centers for Disease Control and Prevention found that more than half of the 238 fatal dog attacks in the United States over two decades were caused by pit bulls or Rottweilers.
This year, Massachusetts lawmakers have explored a state pit bull ban similar to those adopted by some municipalities nationwide.

From Ireland today comes news of yet another vicious dog attack, Rotweilers involved in this one.

A six-year-old girl was left "caked in blood and screaming" after being savaged by two Rottweiler dogs in the North.
The animals bit the youngster's ears and left lacerations all over her arms before her frantic mother managed to save her from imminent death, during the attack which happened last Tuesday.
Sophia Kimpton underwent surgery following the attack at a home near Ballymoney, Co Antrim, while she was on holiday from London.
"They were attached to her head and were just constantly shaking her around just like a rag doll," said her mother, Natasha Beckett.
Mrs Beckett said her daughter would have been killed if the attack had lasted any longer. She will be left with scarring on her scalp.
Her mother described cradling Sophia in her arms and fending off the dogs.
"All they wanted to do was just kill her," she told the BBC.
"She was just caked in blood and screaming. All her flesh was hanging right out of her arms.''
The family were staying at a holiday chalet near Dervock, outside Ballymoney.
Sophia's father, Lawrence, attempted to kick the animals off before the farmer who owned the dogs shot them.
The girl suffered 17 injuries to her head, arms and back during the incident at Conagher self-catering chalets, on a working farm.

Pit bulls at Vick's house face deadline

By ZINIE CHEN SAMPSON, Associated Press Writer

RICHMOND, Va. - More than 50 pit bulls seized from Michael Vick's property face a Thursday deadline to be claimed. If no one comes forward, they could be euthanized.
Federal prosecutors filed court documents last month to condemn 53 pit bulls seized in April as part of the investigation into dogfighting on the Vick's property. No one has claimed any of the dogs, which are being held at several unspecified shelters in eastern Virginia, the U.S. Attorney's office said Wednesday.
The civil complaint filed by federal prosecutors does not name the Atlanta Falcons quarterback and is separate from the criminal case against him. But it does state the pit bulls were part of the dogfighting operation known as "Bad Newz Kennels," which Vick and three cohorts are accused of operating.
Also included in the document are detailed allegations about the nature of the animals' training regimen and the dogfights occurring at Vick's property at 1915 Moonlight Road in Surry County.
The government filed three public civil forfeiture notices in a Richmond newspaper to publicize the dogs' confiscation, and the deadline for claims is 30 days after the appearance of the final notice, filed July 24.
Federal prosecutors declined to comment Wednesday on the seized dogs. Typically, when confiscated property goes unclaimed, the government asks the court to have the items declared forfeited. In this case, U.S. District Judge Henry E. Hudson will make the final decision on the dogs' fate.
"There's no dispute over who owns the dogs," said Daphna Nachminovitch, a spokeswoman for People for the Ethical Treatment of Animals. "Obviously this is not going to be a process where someone steps forward and says, 'This is my dog, can I have her back, please?' "
Though Hudson, who also is handling Vick's criminal case, will determine what becomes of the pit bulls, Nachminovitch said that it's likely that they will be euthanized because they're not adoptable as pets.
"These dogs are a ticking time bomb," she said. "Rehabilitating fighting dogs is not in the cards. It's widely accepted that euthanasia is the most humane thing for them."
Vick, 27, said through a lawyer this week that he will plead guilty to a federal charge of conspiracy to travel in interstate commerce in aid of unlawful activities and conspiracy to sponsor a dog in an animal fighting venture. He is scheduled to enter his plea agreement Monday and could face up to five years in prison.
Three Vick associates have pleaded guilty to the conspiracy charge and agreed to testify against him if the case went to trial. They said Vick provided virtually all the gambling and operating funds for the Bad Newz Kennels enterprise. Two of them also said Vick participated in executing at least eight underperforming dogs by various means, including drowning and hanging.
The locations of the shelters holding the dogs haven't been disclosed out of concern that the animals could be stolen, Nachminovitch said.
"They are a hot commodity in the world of dogfighting," she said.

A legal consideration to ponder in the East Bridgewater Pit Bull case...could the Chief cite exigent circumstances as a reason to go into the house and sieze the dog? It sounds like a stretch at first glance but the dog has already proven to be a public safety threat if it gets loose....

Police looking for owner of dog after a little girl is bitten by a pit bull

FITCHBURG, Mass. -- While Hannah Cummiskey, 3, was waiting for her bus, a pit bull puppy lunged at her and attacked her.
"The dog just lunged right up and hit her in the face," Thomas Cummiskey, Hannah's father, said.
Cummiskey says that he was sitting on his front steps while he was waiting for his daughters daycare bus to arrive on Wednesday morning. A woman walked past the father and daughter with a nine-month-old pit bull. When Hannah tried to pet the dog, it allegedly bit her in the face.

According to Cummiskey, the woman walked away with the dog before he could ask her if it had been vaccinated for rabies.
Hannah had five rabies shots, however she did not react well.
"She had cold shakes," Cummiskey said. "She was shivering pretty bad. She was running a temperature of 101.7, and she was complain of real bad stomach pains. And, so we had to bring her back to the hospital."
Police asks that they owner of the dog comes forward so they can disseminate whether the dogs shots are up to date.
Hannah's parents say that they do not want to prosecute the owner of the pit bull, however they just want to know what the dogs condition is.
"We just want to find out... if the dog has rabies shots, so my little girl can be safe," Rebecca Cummiskey, Hannah's mother, said.
If the owner of the dog does not come forward, Hannah will have to have four more rabies vaccinations.
The dog is described as a nine-month-old pit bull, brown in color with a black spot on it's nose, and a cut on it's right ear.

RICHLAND COUNTY, SC (WIS) - Pit bulls have attacked a Richland County Animal Care Officer, officials say.
According to a news release, the officer was responding to an early morning call from Pintail Lane homeowner Tim Conroy, requesting that the department pick up a stray puppy that was being fenced in his yard with his two pit bulls.
Witnesses say the the dogs broke free from their chained leashes and attacked when the officer approached the home.
The officer is at a local hospital, being treated for his wounds.
DHEC has been notified of the incident and Richland County Animal Care is investigating. The animals are currently in the custody of Animal Care.
The owner faces more than $4,000 worth of citations accusing him of owning dangerous and vicious animals and at-large animals. More charges could be pending.
The officers typically use a catchpole when responding to an incident, and the news release says "indications show the officer followed department protocol."

Dog appears to be still in town

Officials seek criminal filing

By Elaine Thompson TELEGRAM & GAZETTE STAFF
ethompson@telegram.com
SHREWSBURY— An application for a criminal complaint has been filed against a Smith Road man who was supposed to remove his pit bull from town after it attacked two other dogs.

Police filed the application in Westboro District Court earlier this month against Adam Flanders, 36, of 29 Smith Road. A clerk magistrate’s hearing is scheduled for Oct. 9 to determine if probable cause exists to issue a criminal complaint. Mr. Flanders is accused of being in violation of state Chapter 140, Section 157, by having a vicious dog that is a nuisance.

After a dog complaint hearing April 23, Mr. Flanders told selectmen that he would be moving from Shrewsbury by the end of July and that he would be taking his dog, Daisy, with him. The complaint was filed by Animal Control Officer Leona Pease.

According to minutes of the hearing, Alan and Angie Govatsos of 16 Bay Road called animal control after Daisy allegedly attacked their dogs, Casey, a beagle, and Sophie, an Italian greyhound, both 10, on two occasions. Mr. Govatsos said the first attack occurred in January while Mr. Govatsos walked his two dogs on a leash near the home where Mr. Flanders lives with his grandmother. He said that Daisy was off leash in his driveway and bolted at his two dogs. Both dogs, he said, suffered puncture wounds on their necks, and Casey’s rump was bitten as well.

The pit bull allegedly attacked the Govatsos’ dogs again in March while the two dogs were leashed and being walked in front of the Govatsos’ home, about 500 feet from where Mr. Flanders lives.

Mr. Govatsos said the second attack was more severe, but both attacks required him to take his dogs for treatment by a veterinarian. He said Sophie’s wound to the neck was so deep that it punctured a salivary gland.

Mr. Govatsos said he has also witnessed the pit bull straining its leash and barking ferociously at children in nearby Edgemere Park.

Ms. Pease, the animal control officer, told selectmen that Daisy has a “high prey drive,” which means its instinct is to attack anything that moves quickly or runs away. She also said that after the first attack in January, she determined that Daisy was not licensed by the town and that Mr. Flanders could not provide proof that his dog had received its shots.

A check with the town clerk’s office yesterday showed that Daisy was licensed Feb. 1, and the dog’s rabies shot is valid until Jan. 30. The records also indicate that the pit bull was 2 years old when it was licensed.

The dog officer also recommended that a microchip be embedded in the pit bull to identify it should a similar situation come up in another town.

At the hearing, Mr. Flanders and a friend, Katie Warman, testified that these were the only two occasions that Daisy had caused a problem. Selectmen unanimously decided that the pit bull was a public nuisance by virtue of having a vicious disposition and for leaving the owner’s property on two occasions to attack other dogs. The board ordered that until Mr. Flanders removed the dog from Shrewsbury by July 31, he was not to have it outside his house unless it was on a leash under his control and muzzled.

Mr. Govatsos said the total vet bill was $600. He said that he filed a civil suit against Mr. Flanders in Westboro District Court in July.

“The finding of the assistant magistrate was in our favor, but only for $100 because Adam told an effective story about how he didn’t have any money,” Mr. Govatsos said yesterday.

Mr. Flanders did not readily return a call seeking a comment yesterday.

Mr. Govatsos said he has not seen Daisy in a couple of weeks. He sees Mr. Flanders pull up to his grandmother’s house in a blue Jetta Volkswagen.

“I just want him out of my neighborhood so I can walk my dogs in peace,” Mr. Govatsos. “My wife and I got FID cards to carry chemical spray. It’s a dangerous situation.”

Trained to be killers, Vick's pups now on death row

HANOVER, Va. – As Commander Sergeant Kevin Kilgore led a reporter and photographer through the dimly-lit back room of the Hanover County Animal Control facility yesterday, he warned them not to put their hands or faces close to any of the individual cages holding Michael Vick's pit bulls.
Fingers could get chewed off. A face could get spewed with dog saliva. Kilgore said a pit bull from another seizure had chomped right through the heavy gauge metal door and escaped its confines. As Kilgore opened the main security, the creak of the door set off an immediate crescendo of barking.

Lawmaker Wants Registry For Dangerous Dogs

No Specific Breed Targeted, Rep. Says

SPRINGFIELD, Mass. -- A Springfield lawmaker has filed a bill that would create a statewide dangerous dog registry.

State Sen. Stephen Buoniconti said he was prompted by the recent mauling of a 9-year-old girl in Springfield by a bullmastiff that was involved in another attack last year.

The legislation would allow local animal control officers to file a court petition seeking to have a dog involved in an attack on a human listed as dangerous.
The dangerous dog registry would be available online and include the dog's photo, physical description and owner information.

Buoniconti told the Republican of Springfield that he's not targeting any specific breed of dog with his proposal.

Dogs that attack intruders or trespassers would be exempt from the registry.

Marine’s pit bull-breeding kennel draws scrutiny

By David Allen, Stars and Stripes
Pacific edition, Wednesday, September 5, 2007

CAMP FOSTER, Okinawa — Okinawa and U.S. military officials are investigating a Marine corporal’s off-base pit bull breeding business.
For almost a year, officials at the Okinawan-American Animal Rescue Society say they have urged Cpl. Brian Booth to cease breeding pit bulls from his apartment near Torii Station, in the village of Yomitan. They claim Booth, assigned to the 3rd Marine Logistics Group on Camp Foster, failed to get permission from his command or a business license from the prefecture.
But more than that, society volunteers fear the dogs Booth is selling will one day be abandoned by their American owners.
“Most Americans return after their tours to the States, where owning a pit bull is banned in many communities,” said Shannon Wellin, a volunteer who is leading a campaign to shut down the kennel. “And so they’d abandon the dogs, and there are already too many abandoned dogs on Okinawa.”
Liz Rouse, society founder and president, said she also fears pit bulls left on Okinawa could wind up involved in organized dog fights, which in Japan are legal as long as no gambling is involved.
“Pit bulls are the prime breed for these horrible contests,” Rouse said. She claimed, however, that the reason behind the push to shut down Booth’s Ryukyu Block Head Kennels is not a reaction to the recent headlines surrounding Atlanta Falcons quarterback Michael Vick’s pit bull fighting business in Virginia.
“Personally, I have nothing against the breed,” Rouse said. “But we also know that they are at risk for being used for fighting.”
Wellin and Rouse said they have been in e-mail contact with Booth for months and claim he told them that he sold his pups for $1,200 each. They also said they have seen classified ads in local papers with his name on them.
Rouse said she e-mailed Booth advising him pit bulls could be used for illegal purposes and could be hurt.
“He said what happened to the dogs after he sold them was out of his control,” she said.
Rouse said she also advised the Marine that he was violating Japanese laws regarding breeding and a military order restricting business activities by Defense Department personnel and their families.
Booth did not respond to Stars and Stripes’ e-mail requests for an interview or return phone calls. Posted recently on his Web site, http://ryukyukennels.bravehost.com, was a description of Ryukyu Block Head Kennels.
“I believe in producing pits, with large heads, stacked with muscle but that are still lean,” it stated. “… All my dogs are raised around kids and other pits, they may have the drive and ‘gameness’ in there bloodline but they all have excellent temperaments.”
On Sunday night, the site carried this message: “We have no future breedings planned until I return to the states.” The description and information about individual dogs had been removed.
Citing an ongoing investigation, Marine officials would not comment specifically on Booth’s breeding business.
In response to a query concerning personal businesses operated by servicemembers, Marine Corps Bases Japan spokesman 1st Lt. Garron Garn, said “U.S. forces personnel in Japan must file a request for approval with the service component commander or the commander’s designated representative, describing in detail the nature and scope of the proposed activity.”
Garn said it did not matter whether the business was operated from an off-base home.
“The requirements to receive approval for on-base businesses and off-base businesses are the same,” he said.
Rouse and Wellin said they reported the breeding business to Booth’s command Aug. 22. Wellin said the commander called last week to inform her that “they are pursuing a criminal case.”
“We want to note that the Marine Corps has worked with us completely and is trying to put a stop to the illegal breeding that is being done by its servicemembers,” Wellin said.

From England

Killer dog was 'jealous' of Ellie

Ellie suffered severe head and neck injuries

The mother of a five-year-old girl who was mauled to death by a pit bull terrier has told a court how the dog was "jealous of her and hated her".

Lindsey Simpson, 25, told the jury at Liverpool Crown Court it was jealous of her daughter because it was not allowed in the house when she visited.
Ellie Lawrenson died in the attack at her grandmother Jackie Simpson's home in St Helens, on New Year's Day.
Jackie Simpson denies the charge of manslaughter through gross negligence.
Jackie's daughter, Lindsey, told the jury the dog, called Reuben, would be outside whenever her daughter visited the home in Knowles House Avenue.

Impending birth
She said: "I used to look through the windows and say, 'Never let this dog get in the house.'"

"It would look in and I could see it was jealous because it was outside and she was in.
"It was common knowledge for the dog not to come in. Everybody knew what it could do if it got a child."
The court was told Ms Simpson, who has another child, Joshua, had said she wanted the dog to leave the house well before he mauled Ellie.
She said she used Joshua's impending birth in September 2006 to force the family to get rid of the dog because she did not want it around her children.

Banished outside
She told the jury: "I couldn't wait for Josh to be born because it wasn't coming in the house again - I hated the dog." As her mother sat in the dock weeping, Ms Simpson added there was no reason to tell her mother to keep the dog away from Ellie on New Year's Eve. She knew the rule and had a hand in making it, she told the court.

"The decision was made by me, mum, Kiel, Kelsey and Darren that when Josh was born the dog would be in the garden," she said.
"Every time we went through the back door we would make sure the door was locked and the key out because Ellie loved the dog and the key would be out of her reach.
"Mum agreed to that arrangement."
The court has heard how Jackie Simpson, 46, had taken drugs and alcohol on the day that Ellie was killed.

'Just evil'
The youngster, who used to put her arms around the dog and hug him when he was a puppy, suffered 72 injuries when the dog locked its jaws around her throat and shook her in the fatal attack.
The dog, who was later shot by police, was described in court by Ellie's father, Darren Lawrenson, as "evil".
"Its eyes were just evil, anyone who came into contact with it would say it looked evil," the 31-year-old self-employed leaflet distributor told the court.
He referred to Jackie Simpson as "stupid" and said he wanted people to know she was to blame for Ellie's death.
"Without doubt she ended Ellie's life", he told the court. The trial was adjourned until Wednesday.

FREMONT, CA - A mother is recovering after a pit bull attacked her and her 4-month old son. To protect her son during the mauling, 32-year-old Angela Silva put her child into a nearby trash can, saving him from any major injuries.
Silva, a special-education teacher, says that she was holding her son, Tom Jr., when she went to clean her car in the garage. The dog, which belongs to a next-door neighbor, entered through the open garage door and lunged at her and her baby.
In an interview with KRON 4's Jonathon Bloom, the mother said she tried to take the brunt of the hits to save her child, ""I blocked him by getting down on my knees and I put my arms up so that the dog would continue to attack me rather than go for my son."
Due to severe injuries sustained to her arms, Silva has received 50 staples and countless stitches.
A neighbor in the area told Bloom that this isn't the first time this dog has attacked and it has created a sense of unrest in the area, "I just feel like it's not even safe in the neighborhood. We have little kids that go around in this neighborhood, and there's no way they could defend themselves form a pit bull like that."
Though police have asked for the dog to be turned in, the owners claim it ran away.
Silva believes they are hiding it and asks for an apology to be more than just a verbal acknowledgement, ""If they want to be sorry, put that dog down. Don't hide it. It hurts me to know it's still alive."

Woman sics dogs on officers at arrest

By John R. Ellement, Globe Staff | September 12, 2007

A Roslindale woman allegedly unleashed at least two pit bull dogs on Boston police officers as they tried to arrest her inside her house yesterday. But police said she was the one who ended up being bitten.
The woman, Donna Pimentel, 47, was wanted on warrants from three district courts on charges including larceny, drug possession, and making annoying phone calls, authorities said.
Police arrived at her three-story home on Ridge Street about 9 a.m. and handcuffed the woman, but she insisted they had the wrong person and demanded to be allowed to enter a first-floor apartment to get her identity papers.
The dogs, which had been in the backyard, had raced inside the apartment when police showed up. Police tried to distract the dogs, but the woman egged them on.
While officers and the woman huddled in a rear stairwell, one of the dogs bit the woman in the thigh.
Animal control officers arrived and corralled the dogs, police said.
The house, which police said may have been an illegal rooming house, was in complete disarray, with most rooms littered with dog feces and urine, police said. The dogs were taken to the animal control shelter in Roslindale.
The woman was charged with assault and battery with a dangerous weapon and resisting arrest.
She was wanted in Boston Municipal Court for driving after suspension and in Dedham District Court for larceny over $250. She was also wanted in Woburn District Court for making annoying phone calls, police said.

The stories just go on and on. Who the frigg would want to own a dog like that? Like some one else mentioned, I think the main(meaning not the only) reason is because its trendy. Look at me with my mean looking dog. The only place for them should be at the zoo.

You will never get an accurate account of the "Type" of person who owns a Pitbull just like you will never get an accurate "Type" of person that owns a gun. You have law abiding citizens that own guns and use them responsibly then you have the other side. I have had many dogs in my life including Pitbull Shepards Goldens Rotties etc etc. I feel I am a responsible dog owner my dogs are always under my control when out walking. I train them in obiedence classes and several other dog events. Unfortunatly the wonderful ganstas decide to use pitbulls as status symbols. Pitbulls can be wonderful companions in the right hands i.e. people that have experiance with dealing with the tougher breeds. In the wrong hands as you can see they can be VERY dangerous. All I ask is that you remember statistics can show what every you want them to its all in how you spin it. Obviously every one of these attacks is a terrible tragedy I would not disagree with that. Every one is still entitled to their opinion and Delta I guess we will have to agree to disagree.

Everyone be safe out there.

Man Drags Pit Bull To Death Behind Vehicle

(CBS News) ORLAND, Ind. An Indiana man angry that his pit bull had killed his Chihuahua dragged the pit bull to death behind an SUV, police said.

Kevin Collins, 20, was arrested and charged with felony animal cruelty. He remained incarcerated at the Steuben County Jail on $10,000 bail Saturday night.

A woman driving along a county route on Thursday saw the animal being dragged along the dirt road, noted the SUV's plate number and called 911, police said.

Police said they found Collins at his parents' house. Collins told police he dragged his pit bull because it killed his other dog.

According to CBS affiliate WANE Collins first shot the dog and then dragged it along a rural dirt road.

Afterward, Collins dumped the dead dog along the road and left it, police said.

A neighbor, Ginny Workman, told WANE, "I'm shocked that Kevin would do something like that, I am totally shocked, because he is a nice kid."

If convicted, Collins could be sentenced to six months to three years in jail.

You got shit for it because somehow you tried to equate 1 "other breed" attack to being equal to like 20 pit bull attacks. When other breeds start going one for one with pit's on attacks...then your statistics will be "valid".

Cops: Georgia Man Fed Cats to His Pit Bulls

LAWRENCEVILLE, Ga. — A man captured neighborhood cats and kittens and fed them live to his pit bulls, authorities said Thursday. Tye Hilmo, 21, was charged Thursday with aggravated cruelty to animals.
Hilmo was already in jail on drug, firearm and probation violation charges, Gwinnett County sheriff's spokeswoman Stacey Bourbonnais said.
The new warrant charges that Hilmo "did give injured live cats and kittens to his pit bull dogs and let the pit bulls kill the already injured cats and kittens. Hilmo would capture and injure neighborhood cats for this purpose."
He was arrested Sept. 10 after investigators serving a search warrant on his house found guns and two pounds of marijuana, Bourbonnais said. He has been jailed since then.
Authorities found the bodies of two kittens near Hilmo's residence. Bourbonnais said they also found a gruesome image on Hilmo's cell phone: a picture of one of his pit bulls and one of the mauled, dead kittens, and beneath picture a caption that says "Good Dog."
"It's pretty disturbing," Bourbonnais said.
The initial tip about Hilmo indicated he may be feeding kittens and cats to his dogs to prepare the dogs for fighting, but no dogfighting charges have been leveled against Hilmo, Bourbonnais said.
Sheriff's officials could not immediately say whether Hilmo has an attorney.

Dracula's Kittens Fed to Pit Bull

(Dracula, Georgia) A 21-year-old Dracula man, Tye Hilmo, was arrested by Gwinnett County Sheriff's deputies for animal cruelty. It was discovered that Hilmo was feeding neighborhood kittens to his pit bull.
Deputies got a tip that some sort of animal cruelty had been going on at the Hilmo's house in Dacula, involving the pit bull there. They found two pounds of marijuana, a sawed-off shotgun and other weapons, and two dead kittens. How those kittens died is what brought the cruelty charges against Hilmo.

"He was getting the kittens and cats from the neighborhood," said Stacey Bourbonnais of the Gwinnett County Sheriff's Office. "And he was injuring those kittens and cats before he was giving them to the pit bull to maul and kill."

One more piece of evidence from the case was on Hilmo's cell phone. He had a picture on his phone of his dog, with parts of a kitten in its mouth. The caption on the picture read, "Good Dog."

At approximately 10:30 a.m. today, Montgomery County Police 6th District officers responded to the walking path in the vicinity of the 8900 block of Clewiston Place in Montgomery Village, regarding the report of a woman being attacked by two dogs.

Officers located a pregnant woman on or near a walking path. Two dogs, both pit bull mixed breeds, were found near the woman still fighting each other; and therefore continuing to pose a threat to the safety of the woman and the responding officers. The victim, a 28-year-old woman from Montgomery Village, was the dogs’ owner. The officers utilized their service weapons to put the dogs down. The victim concurred with their decision. The victim was transported to a local hospital for treatment of severe bite injuries to her arm and scratches to her cheek.

The ensuing investigation revealed that she was walking the dogs and they became aggressive when another dog approached. The victim’s dogs began fighting each other. When the victim attempted to stop the dog fight, the dogs attacked her.

The Montgomery County Police Animal Services Division has taken possession of the deceased dogs for rabies testing.

My friend is a 6th District officer and was involved in this case. He told me that the woman was badly injured by these dogs.

Who no doubt used to fawn all over them and tell everyone how gentle they were.

Until they turned on her.

They were good dogs, they were turning their life around.

You're not gonna get an argument from me. I'm sure they were "the sweetest dogs in the world" until they bit the shit out of her.

From what I gathered from my friend, the owner who was injured was also asking the officers to shoot the dogs at the scene (which they were going to anyway). But at least she wasnt begging them not to...

I heard they also recently signed rap record contracts.

I have posted some in the past and just gotten shit for it...so why bother? You all will never know the love and affection of a good bully...

KTT, that's the first time I ever heard the term "bully" used for pitbulls. Usually you think of a bulldog when you hear "bully". Obviously two very different breeds of dog. You learn something new each day I guess. I agree with most, this post has gone on forever and ever and ever and ever......

NYPD Officer Bit in Groin by Pit Bull

MURRAY WEISS

NEW YORK-- No good deed goes unpunished.
A kindhearted Bronx cop learned that painful lesson outside his station house where a pit bull he found abandoned and tied to a light pole bit him in the groin - and had to be shot and killed by two fellow officers.
The tale unfolded at around 9 p.m. Monday when an anonymous 911 caller reported that a dog was left tethered for hours to a pole outside 1 Fordham Plaza in the Fordham section of The Bronx.
Two cops, whose names were withheld, responded to the scene, and found a sad-eyed 40-pound pit bull lying on the pavement, seemingly starved for food and affection.
They walked up to the dog and it appeared to be friendly and comfortable with people.
In fact, the pooch seemed so friendly, the cops decided to take him in to the station house without calling for Emergency Service Unit officers, who are supposed to be summoned if an animal is "vicious," according to guidelines.
"The dog seemed really nice," a source explained. "They petted it and it appeared to be docile. The pooch was so friendly, they decided to take it."
The veteran officers, with scores of collars between them, untied the animal and placed it in the back seat of their squad car, where it sat happily, separated from them by a metal partition.
As the cops headed back to the 48th Precinct station house, they decided to stop at a convenience store to purchase a couple of cans of dog food.
Once they got to the station house, one cop went inside for a plate while the other went to get a small dog cage.
When they returned, they opened the door and let the dog out into the alley, where they were about to feed it.
Suddenly, the seemingly warm and fuzzy animal turned beastly, sinking his fangs into the groin of one of the cops who had rescued him.
"It was bizarre," a source said. "The dog was very friendly . . . until it went nuts."
The dog was so wild that the cop's partner and another officer were forced to come to their colleague's rescue, firing one shot each into the animal.
The sound of gunfire sent dozens of concerned cops rushing outside.
Sources said the wounded officer was taken to St. Barnabas Hospital, where he received four stitches.

That should be the official motto of the Pit Bull.

Note to NYPD: When a Pit Bull is left abandoned, there's probably a very good reason for it.

At least an assault rifle doesn't start firing for no apparent reason.

Pit Bull Terriers Kill Owner in Florida

MIDDLEBURG, Fla. — Two pit bull terriers fatally attacked their owner who had raised them since birth, authorities said Tuesday.
Tina Marie Canterbury, 42, was walking to her back yard when the 2-year-old redbone pit bull terriers attacked her, according to the Clay County Sheriff's Office.
One of Canterbury's sons tried to help her, but the dogs attacked him. He was not seriously injured, authorities said.
A family friend shot at the dogs to scare them away. A deputy shot one of the dogs. The other dog ran away but was found two hours later and killed, authorities said.
Clay County Sheriff Rick Beseler said he couldn't remember such a severe dog attack since becoming sheriff three years ago.
There were no signs of dog fighting or other abuse at the Canterbury home, authorities said.

Breeding Discontent

By Maria Papadopoulos, Enterprise staff writer

BROCKTON — Soldier, a hefty brown pit bull, ran up to the spring pole — a device used to strengthen a dog's jaw muscles — sunk his teeth into the rope and swung.

His owner, Rico Carrasquillo, says it's a healthy way to exercise the pit bulls he breeds and sells to the public — but neighbors and animal experts say it's a dangerous way to train an animal.

“I try to get the dog as (physically fit) as I can. Obviously, the dog can't lift weights,” Carrasquillo, 24, said from his sister's Pine Street home Wednesday as several pit bulls barked in cages nearby.

Now, the two sides are expected to state their cases at 7 p.m. Wednesday at City Hall, when Carrasquillo and his sister, Angelica Ortiz, will appear before the Zoning Board of Appeals seeking a kennel license to expand their operation.

City residents with three or more dogs must have a kennel license, according to city ordinance.

The license would allow Carrasquillo and his sister to board and sell pit bulls, which go for as much as $3,000 apiece.

But residents in the Ward 5 neighborhood are fed up with Carrasquillo's dog business, saying it doesn't belong in a residential area.

They are also fearful — that the muscular dogs will escape and hurt someone, that the business will grow and become a bigger nuisance, and that the dogs are being trained for possibly fighting some day.

“It's my daughter's safety and then the safety of those dogs,” said neighbor Kim Tapper, 41. “Any dog in that situation is going to be aggressive.”

Brockton animal control officers gave the siblings a cease-and-desist order in August to stop breeding the dogs because they do not have a kennel license.

Neither the animal officers nor Brockton police have found evidence of dog fighting at the home.

“I want to know where does all this dog fighting (expletive) come from in Brockton,” Carrasquillo said. “Nobody in Brockton fights their dogs. You don't hear that from nowhere. I've never been to a dog fight in my life.”
“We don't agree with what Michael Vick did at all,” said Ortiz, 28, a nurse manager at St. Joseph Manor nursing home.

She was referring to the high-profile case of Vick, the Atlanta Falcons quarterback who pleaded guilty in August to federal conspiracy charges related to dog fighting on his property in Virginia. Vick is to be sentenced on the federal charges on Dec. 10.

“It's cruelty. You don't do that,” Ortiz said. “It's like your kid, you don't do that to your kid. You don't put your kids out to fight, why would you do that to dogs?”

Several pit bulls were housed in cages in Ortiz's back yard on Wednesday. The cages were covered with red and green tarps that read, “Pit Bulls — Keep Out.”

The grassless yard contained the cages and two spring poles, one hanging from a tree.

One brown pit bull was chained to a wooden dog house. Another pit bull sat in a kennel inside the kitchen on the first floor of the two-family house.

So far this year, police have responded to Carrasquillo's home 13 times, mostly for complaints about his dogs.

“If we get calls, we investigate it,” Brockton Animal Control Officer Thomas DeChillis said. “We check the dogs over to see if they're marked up and outward indications to see if they've been in a dog fight. ... I don't believe we found any indications that (Carrasquillo's) dogs were involved in a fight.”

The MSPCA has also been to the home, Carrasquillo and DeChillis said.

“They have nothing to say because they know I'm not doing nothing wrong,” Carrasquillo said.

Brian Adams, an MSPCA spokesman, said Wednesday the MSPCA is not currently investigating anyone at that address.

One neighbor said she has seen five to six men go up to the fences and bait the dogs, then laugh.

“It's frightening,” the neighbor said. “It was enough to convince me that it's not for this neighborhood.”

While spring poles are legal for dog owners to use to exercise their dogs, the Massachusetts Society for the Prevention of Cruelty to Animals does not advocate using them with pit bulls, said Scott Giacoppo, the agency's deputy director of advocacy.

“One of the reasons why we don't advocate using a spring pole for pit bulls is because if one of those dogs does bite someone, whether it's provoked or unprovoked, justified of unjustified, it will cause a very serious bite,” Giacoppo said.

“We don't like to see that in pit bulls because they already have that negative reputation because people use it for the wrong reason.”

Carrasquillo called the spring pole “really a toy more than a training device” for dogs. He said he also uses a manual treadmill to train his dogs.

“When they get on it, they run at their own pace,” he said.

He said he screens people before selling his dogs, signs contracts with the buyer and has checked up on dogs he has sold “plenty of times.”

He said he has gathered about 50 signatures from people in his neighborhood to allow for his kennel license.

“I'm trying to take these dogs out of the negative limelight that they have so much of,” he said.

If he gets the license, he plans to call his kennel Precious Pits Kennels, named after a dog he had as a youth and “because the pit bulls are really precious.”

Carrasquillo is one of two city residents applying for a kennel license that will be considered at Wednesday's meeting.

Grace Hernandez, of John Berman Drive, is applying for a kennel license. City officials say her nine dogs are mostly chihuahuas and are all spayed and neutered.

Couldnt agree more. These dogs are overbred already the last thing we need is more. He states his dogs are not for fighting. But I wonder out of the dogs he sells, how many followups does he do. I would venture a guess of zero. As fond of this breed as I am I lean toward the possibility of banning the breeding of them. But then again I dont endorse the breeding of any breed due to the overpopulation of dogs in the world already.

Brockton dog breeder denied kennel license

By Maria Papadopoulos, Enterprise staff writer

BROCKTON — A city dog breeder was denied a kennel license to breed and sell pit bulls following a Zoning Board of Appeals hearing Wednesday night at City Hall.

“I'm disappointed, but what can I do?” said Rico Carrasquillo, 24, his eyes brimming with tears, after the board heard his case.

Carrasquillo, and his sister, Angelica Ortiz, had applied for the kennel license after months of complaints by neighbors who abut their Pine Street home.

“I want to breed more than five litters a year at my house,” Carrasquillo told board members.

Brockton Animal Control officials gave the siblings a cease-and-desist order in August to stop breeding the dogs because they do not have a kennel license.

Several dogs were for sale Wednesday on Precious Pits Kennels, a Web site operated by Carrasquillo.

“We are a small, family-owned kennel breeding Champions in the City of Champions,” the Web site states.

Wednesday night, more than two dozen abutters to his property and several city councilors vehemently opposed Carrasquillo's proposal. One city resident spoke in favor of it.

“He's already selling the dogs on the Web site. They're breaking the law,” said Ward 5 Councilor Dennis DeNapoli.

Mary Lanza of Brockton, a volunteer for BraveHeart Pit Bull Rescue in Lakeville, opposed the proposal, saying there is a severe pet overpopulation crisis in the community.

“Every puppy produced by a backyard breeder and placed in a home takes the place of one killed in a shelter because no one adopted it,” Lanza said during the hearing.

Several of Carrasquillo's neighbors complained the dogs bark constantly. Others were concerned about the safety of children in the neighborhood.
“We have our kids in our house, too, and we wouldn't do anything to endanger anyone's children,” said Carrasquillo.

Zoning board member John Cahill said the denial of the application has nothing to do with the breed of dog, but more so with putting a commercial business in a residential area.

“Why do you want this board to impose upon the neighbors a business operation in a residential area?” Cahill asked Carrasquillo during the hearing.

City residents with three or more dogs must have a kennel license, according to city ordinance.

Last week, Carrasquillo said he has 10 dogs on his property. Brockton Animal Control officials said six adult pit bulls on the property are licensed with the city.

Carrasquillo has 20 days to appeal the ZBA decision from the date it is filed in the clerk's office, city officials said.

He said if he can't have his dogs in Brockton, he is leaving the city.

“I'm going to move. Wherever my dogs go, I'm going,” he said, fighting back tears. “They're like my kids.”

Springfield Woman Faces Charges of Animal Cruelty

October 12, 2007 6:31 p.m.

SPRINGFIELD, MASSACHUSETTS (WWLP) Oliver, a two-year-old Brindle Pit Bull mix, was removed from the home of Camilla Hodges, a Springfield woman who lives on Quincy Street in the city. MSPCA Law Enforcement is calling this a blatant case of animal neglect and cruelty.
The MSPCA said Springfield police raided her home for an unrelated matter Wednesday when they stumbled upon Oliver, an extremely emaciated animal. Her arrest at 1:30 p.m. marks the second time since 2004. Hodges has been arrested for felony cruelty to animal charges.
Many people at the Thomas J. O'Connor Animal Control and Adoption Center were disgusted by the condition of this well-mannered pit bull just by looking at him.
"It was covered in urine, scalding from lying in its own filth---a definite case of animal cruelty and neglect---something that is one of the main reasons why the laws changed to a felony in 2004, because it's so serious," said Christine Allenberg, with the MSPCA Law Enforcement.
Another dog, Piglet, suffered mange and neglect from Camilla Hodges back in 2004. In 2004, Hodges became the first in the state to be convicted on felony animal cruelty charges and Hodges is still being booked on Friday's current charge for what she allegedly did to Oliver.

Charging Pit Bulls Shot by San Antonio Officer

SAN ANTONIO --
A dog owner said an officer fatally shot one of his pit bulls and injured the other in his yard when they attacked the officer on Sunday afternoon.
"I heard about three or four shots," David Moreno said. "I mean, I hear those dogs, I live with those dogs, no barking -- nothing. I just hear gunshots."
Moreno said the officer was responding to a call made by Moreno's mother, who wanted to file an unrelated police report regarding harassing phone calls.
Sgt. Rudy Lopez said the officer walked into the fenced yard and the pit bulls attacked.
"That's when the dogs came around the house and they charge him and he tries to fend them off with a baton," Lopez said.
However, Moreno said the officer put himself in harm's way.
"He put himself in that predicament by passing a sign that says beware of dog," Moreno said.
The San Antonio Police Department plans to conduct an internal review of the incident -- a standard procedure conducted any time an officer fires a weapon.

Court: Pit Bull No Reason To Enter Home Without Knocking

Police Can't Get By On No-Knock Warrant

BOSTON -- Score one for pit bulls.

The state Appeals Court has ruled that police can't use a general fear of pit bulls to enter a suspect's home without knocking.

The court says police shouldn't have been allowed to get a "no-knock" warrant to enter the home of a Springfield man based on their claim that the man's pit bull might have hurt the officers who conducted the search.
Luis Santiago is charged with drug offenses and receiving stolen property.

Prosecutors appealed a lower court ruling suppressing evidence seized from Santiago's home based on the improper search warrant. But the Appeals Court upheld the suppression order.

The court says police have to show a particular pit bull is violent, instead of claiming all pit bulls are aggressive.

Protective pit bull helps case
WOMAN'S DOG FOUGHT OFF INTRUDER,
PROVIDED DNA CLUE THAT LED TO SUSPECT'S ARREST

By Sean Webby
Mercury News

San Jose Mercury NewsArticle Launched:10/26/2007 01:36:15 AM PDT

This was a pit bull mauling everyone can cheer.
Except Anthony Easley.
Easley, 37, was arraigned Thursday on charges of an attempted sexual assault and burglary that took place four months ago in San Jose. It was an attack stopped, and ultimately solved, authorities say, by the ferocious protectiveness of Maya, a 4-year-old pit bull who ended up with the suspect's blood on her face.
The sun was just coming up June 17 and the 31-year-old single mom - who asked not to be identified - was coming back to an empty house. Although she had spent the evening celebrating her birthday at the San Pablo Casino, her spirits were low - she had recently lost her job.
As she started to unlock her front door, she saw a shadow out of the corner of her eye. Someone shoved her from behind.
"My boyfriend works for the police department," she screamed at the mysterious intruder, "and he will be home any minute."
The desperate fib died in her throat as the man began strangling her. "Shut up," he growled as she tried to stab him with her keys.
"Then, I saw my dog's white streak coming from the other room," the victim said. "Maya," she gurgled, "get him!"
Maya attacked. She had always been a gentle dog, ever since the victim adopted the pit bull mix as a puppy from the Humane Society, falling in love with the white dog with brown spots and floppy ears.
Now, Maya was tearing and ripping the stranger's arms.
The man tried to fight off Maya with one hand while keeping his other hand around the woman's throat.
"That's when I grabbed him," said the victim, "where the sun doesn't shine."
At that very painful moment, the attacker let her go.
With Maya snarling and snapping, the attacker gave up. The victim held Maya by her collar as the attacker fled.
When San Jose police officers Iain Fry and Chris Kubasta arrived at the house they didn't find much beyond the signs of a violent struggle. But then, they noticed what looked like a smudge of red above the dog's right eye - possibly the suspect's blood and DNA evidence.
Because Maya was frenzied the victim had to hold her behind a door, while the officer reached around and swabbed a spot just above the dog's snapping teeth - once, twice, three times.
Even Fry didn't think much would come of the sample.
"We never thought they would even run 'em," Fry said of the swabs. "I mean, there's no way - you are talking about one drop of blood on a dog's head. A million to one."
The victim's descriptions helped create a composite sketch.
After checking all sex registrants and other violent parolees in the area, detective Ryan Kimber ran out of leads within a few days.
"In these stranger cases, where there is no relationship between the attacker and the victim, well, those can be very difficult to solve," said Lt. Mark McIninch, who heads San Jose police's Sexual Assault Investigations Unit.
Maya was now hyper-protective, snarling at anyone who came too close to the house or to the woman and her 11-year-old son. Always proud of her strength and independence, the woman said that after the attack, she was scared, depressed, barely able to get out of the house and crying all the time.
"I thought he would come back all pissed off," she said, "and finish off what he did."
But months later, Fry and Kubasta's diligence paid off.
The Santa Clara County crime lab extracted human DNA from the swab. It was then matched through the state's database of samples taken from anyone convicted of a felony and those arrested or charged with a homicide or sex offense. Ultimately, all information led to Easley, police and prosecutors said.
"It was the saving grace and one of those 'above and beyond' efforts," Kimber said of the police work. "It's what saved this case."
Easley was previously convicted of two sexual felonies in Solano County, according to court documents. He also was convicted of robbery in Contra Costa County. Now, as a third striker, he faces life in prison if convicted, said Santa Clara County prosecutor Michael Fletcher.
When San Jose police called detective J. Melville in Vallejo, he volunteered to find the suspect. Several hours later, he did. Easley lived near the police department.
Kimber told the victim, who had bought a two-pound steak for Maya after the attack.
The woman went home and cried. She hugged Maya. "What," she said "would I do without you?"

There should be no breed specific bans AT ALL. I would be more apt to support licensing owners and giving even a basic personality test to see if they can handle the dog they want.

Pit Bull Stands By Owner In Tanker Crash

Loyalty Proven By Man's Best Friend

POSTED: 2:28 am EDT November 3, 2007

EAST LYME, Conn. -- One canine certainly fulfilled the role of man's best friend on Friday.

Witnesses described seeing a tanker truck barrel through the median into oncoming traffic, killing three people and injuring three others on Interstate 95 in East Lyme late Friday morning. The tanker struck a tractor-trailer and at least four cars and overturned.

As chaos broke out on I-95, a heroic pit bull remained calm, sitting in the front seat of a tractor-trailer hit by a tanker truck. As the truck crumbled, the dog stood tall, staying beside his owner until help arrived.

"I was calling to him, but he was just standing there and just guarding his person," said Phyllis Martino, a witness at the scene.

The heroic dog stayed right by his owner's side, but arriving firefighters quickly rushed that badly injured driver to the hospital.

That's when another hero was standing by to step in. Vincent Gagliardi said the pit bull was frantic as his owner was carried away. So, Gagliardi took off his belt, ran to the dog, fashioned a leash and got the dog out of there.

"This guy was still sitting in the passenger seat, and there was diesel fuel all around, so I took him out of there," Gagliardi said.

Authorities did not release on Friday any identities of those involved in the crash.

WISCONSIN – A 4 month-old Waukegan, Wisconsin boy is in stable condition after a dog chewed off his genitals.
The infant was asleep on a couch when a Dachshund allegedly ate through his diaper – not stopping even when he had chewed the boy's genitals off.
The dog is owned by the girlfriend of the boy's father – authorities suspect it smelled the boy's soiled diaper.
The boy's father says he and the girlfriend were in another room when the incident occurred, at around 1:30 am Sunday. The girlfriend awoke to the boy's screams and found him bleeding profusely before calling 911.
It has been determined that the boy's genitals were too badly damaged to be reattached.
In October of this year, an infant in Memphis suffered genital mutilation when an 8-week old puppy ate through his diaper. That dog was not euthanized because of its age and general demeanor.
It has not been determined what will happen to the Dachshund. The boy is receiving treatment at Children's Memorial Hospital in Chicago.

California Officers Shoot, Kill Pit Bulls in Self-Defense

LONG BEACH, Calif. --
Long Beach police on Wednesday shot and killed two pit bulls that turned on them after attacking two dogs being walked by their owners, according to police.
Officers who were called to the area of Anaheim Road and Stevely Avenue about 10:15 a.m. were told the pit bulls were loose in the neighborhood, according to Long Beach police Sgt. David Marander.
The canines had attacked a woman and her dog, then went after another dog being walked by its owner, he said.
Police located the animals in a front yard in the 6900 block of El Cedral Street and tried to capture them, but the dogs turned on the officers, who fired in self-defense, Marander said.
No people were reported injured.
