Question on Op. after reg. revocation

Just a quick question.

You stop a vehicle secondary to the reg. coming back revoked due to insurance. Operator is not the owner, not on the reg. OK to charge operator with operating after revocation or would you go with the lesser Op. unregistered?

Charge the owner, not the operator, take the plates and return to RMV, tow the car... if the guy driving a has had a good attitude, give him a ride home.

You can charge both the owner and the operator (if the operator has a crappy attitude) if you want to.

Cite whowever you want, probably won't make much of a difference as it will likely get decriminalized at court and the tow and regsitration will cost triple the legal assessment anyhow.

I often cite the operator if he/she claims the car is theirs. (ie registered in mom or dad's name but is really theirs). If it is company car and they own the company, a leased car or a car registered in the spouses name, I always cite the operator.

Only when it's clearly a case of someone just borrowing someone's car or an employee driving a company car do I cite the owner.

Thanks for the reply folks. I wound up citing the operator as it was the wife driving, car registered in husband's name. She new 100% that the reg. was revoked / uninsured. Your right though, it will get dropped just like everything else. Thanks for the advice.
