A federal appeals court overturned yesterday the cocaine conviction of Mafia captain Robert C. Luisi, 45, of Medford, ruling that he is entitled to a new trial because jurors were not allowed to consider his claim that the FBI entrapped him. Luisi testified at his 2002 trial in Boston that he initially refused to get cocaine for an undercover FBI agent who wanted to trade jewelry and furs for drugs. But Luisi said then-Philadelphia mob boss Joseph "Skinny Joe" Merlino ordered him to do the drug deal. The US Court of Appeals for the First Circuit said the trial judge gave improper instructions to the jury, preventing them from considering Luisi's claim that another high-ranking Philadelphia mobster, who was secretly cooperating with the FBI, had persuaded Merlino to order Luisi to carry out the drug deal.
