Judge: Addison can be tried on lesser counts first

CONCORD, N.H. - State prosecutors will be allowed to try Michael Addison on lesser charges relating to a shooting at an apartment and a convenience store robbery before trying him on a charge that he fatally shot a Manchester police officer, a judge ruled.
Addison, 27, is charged with capital murder in connection with Officer Michael Briggs’s death last fall.
Addison also is charged with shooting at a Manchester apartment the day before Briggs was shot and of robbing a Hudson 7-Eleven five days before.
Judge Kathleen McGuire ruled Monday that since the apartment shooting and robbery happened before Briggs was shot, Addison should be tried for those crimes first. She also said that ”evidence of any convictions” that may result from the trials on the lesser charges ”would probably be admissible” in the penalty phase of Addison’s capital murder trial. If Addison were found guilty, jurors would then decide his penalty: either life in prison or death.
Addison’s lawyers argued that the publicity that would likely surround the apartment shooting and robbery cases would interfere with Addison’s ability to receive a fair trial. But McGuire said that Addison’s lawyers haven’t ”demonstrated the kind of ’inflammatory, adverse press”’ that would that would allow the court to gauge future publicity that would taint the jury trial for the murder trial.
