Community Sues To Oust 3-Year-Old

Child With Drug-Addict Mom Lives With Grandparents

LARGO, Fla. -- A Florida homeowners group wants 3-year-old Kimberly Broffman to take her Big Wheel and hit the road.

They've banded together to oust the toddler from their Tampa-area community, which bans residents under 18.

The child's grandparents, Judie and Jimmy Stottler, admit Kimberly's been living there in violation of homeowners' association rules for three years. They said her mother has a drug problem, and isn't capable of caring for the child.
The grandparents said they live on a fixed income and can't afford to move until they sell their house. So far, there have been no takers to buy their house, even after they lowered the $189,000 asking price by $10,000 six months ago.

They also said they can't afford to hire an attorney.

Judie Stottler supports the family with her $18,000-per year dishwashing job because Jimmy Stottler is disabled and is unable to work.

Judie Stottler's friends told the St. Petersburg Times that they are worried.

"It is so ridiculous that this has gone so far," said Keith Tinsley, a cook who works with her. "She's trying her best to sell her house. It's like they are trying to force her to put Kimberly in foster care.

"These people keep batting her down and batting her down. They're just mean."

Judie Stottler said she is scared that she wil lose her house before she is able to sell it.

"We don't have any family to take us in," Judie Stottler said.

The Lakes homeowners association filed suit to oust Kimberly last month.

Your going to hate me Kate and Eagle, but the homeowners association is right.
It's private property and the rules are thus.

I know if I laid down my hard earned cash to live in a place that had an established set of rules for residents and those rules were then ignored, I just might have a problem with said residents myself.
Empathy for the kids plight notwithstanding.

But Dicks problems cannot become Jane's problems.
Theres too much of that going on already in our society. Although I do feel very bad for the child, as I do for all drug addicts kids.

I am with Koz on this one. If they are making an honest effort to move out I think the homeowner's should give some leeway, but that can only last so long.

However, at what point do these "homeowners associations" become so unreasonable as to dictate who can and cannot live there and what they can and cannot do? No one under 18? Please. We could conceivably create entire communities of no blacks, no asians, no gun owners, no people who own green house gas emitting vehicles, no cops, no vegans, no people with dark hair and dark eyes!! AARP would have their Depends in a knot if a developer suddenly created "No Seniors" gated communities. I can hear the realtor now ~

"Turn in your Buick and park your ass in a nursing home you toothless, pants crapping, nearsighted blue hair - you ain't wlcome here!"

I'm no flaming liberal here but its a very slippery slope when an "association" begins to decide law and the Constitution. What about this association in CT that told a woman she could not fly the US flag, honoring her son serving overseas, because it violated the condo rules? She was told take it down or get out - ARE THEY SERIOUS? THE US FLAG??

This world just is starting to get me worried. Nobody has values anymore. Kids cant celebrate christmass anymore, now its happy hollidays not merry christmass. You cant hang your flag on your house or say the pledge of allegiance in class anymore. Its funny this country fought wars so we could learn to live with each others differences. Now people are offended by the differences we carry on that were started by our ancestors. The same ancestors that went to war. In some towns a guy cant relax and smoke a cigar outside anymore, I'm not a big smoker but if its outside who cares. What does this have to do with a three year old girl getting ousted by a home owners association. Its just that, its a three year old girl that they may get forced away from her family. No values anymore, its turning into a shitty world.

That CT condo thing was in my condo place. We have a czar as a condo president. But he'll be gone soon (with a little ousting from a certain few)...We had a leaking roof and didn't get it fixed until I brought up at a meeting that he was violating a simple license law...There are numerous law suits right now against the president of the association and the association because he's such an ass.

I agree that rules are rules, but these grandparents are doing the right thing...There is only so much they can do. I can see maybe raising their condo fees instead of kicking them out, ya know?
