Randomly Running Plates

Does anyone know the Case Law in Mass, about randomly running registration plates. If no traffic violation or criminal activity is observed can you randomly run the plate? Thanks

Not sure about the specific case law, but think of it this way:

The registration plates are not the property of the vehicle owner, they are the property of the RMV.

You can run whatever plate you want while on patrol. I asked Pat Rogers if I ran a plate that popped a warrant or revoked/suspended license for the registered owner, if I would be justified in stopping the vehicle.

His answer....as long as the stop was limited to finding if the operator was indeed the registered owner, such a stop would be good....."All day long".

They key here is that the plates are not personal property and they are in public view. You dont need PC to run a plate. You can sit on the side of a road and run plates all day long.

It was a Sergeant from Framnigham PD that the case law stemmed from. He is also an attorney. You can run any plate you want anytime as long as you are not profiling.

Can run any plate you want. I know a guy that will run over 300 a night and usally makes at least one arrest as a result.

That's the SOB that's bogging down the RMV....

Our return displays do not come back fast enough for me to have the patience to wait for 300 queries. On a good night I will run 40 to 60 provided that MA and RI RMV's are not offline.

We use PacketCluster 4.34, best version ever, simple and very very fast. I tried IMC Mobile and it SUCKS with all those stupid tabs. Unless you have a touchscreen the IMC mobile sucks the worse. Then the PocketCop new version of PacketCluster with photos sucks big time, too slow.

This was the case that made it all the way to the Appeals Court. It happened in Douglas Ma. There are other District Ct. decisions from Framingham and somewhere out in western Ma. But that is all they are, District Ct. decisions.
