Hello, I have a question for anyone in a Unoin who may have the right answer to this question.
I have a friend who started a Police academy in late 2004. She was paying union dues for 3 months up until her on the job injury. The person was injured severly while in the Academy and was out for almost 2 plus years on Workers Comp getting paid for that city. They were released back to work Full Duty Oct 2006 and went back to work with that dept in another position until another Academy goes in.
What her question is, the 2 plus years she was out what happens to senoirity and pay step raises now that she is back to work full time? I cannot answer this for her because Iam not sure. I have gotten alot of answers from others saying that she should be brought up to the 3th pay step as she was still employed all that time she was out and the city was still issuing her a paycheck every week basically she was on the books?
If any knowledgable union rep can answer this info that would be great so that i can pass it along to her.

What do you mean by another position? A police position?

They put her in the same job title getting paid as an officer but she is doing basically paperwork and other different things until they have another police academy go in, in which she will repeat day 1 till the end.
I couldnt give any info about whether she is intitled to the step increases when she was out on comp and now returned full time full duty a couple of months ago. thanx

Also just to add she has now been paying union dues since returning to work if that makes any difference

that's a good question. my guess is retirement and vacation would be intact , but if she wasn't with group 4 , then she might start off at square one with shift bids and job openings when returning to the PD.
wonder if she has satisfied the one year probation or does that clock reset after she graduates the academy ?

Basically from what she told me she is group 4 and only had 3 months total of Academy training when she was injured. She still needs to finish the entire academy 6 months when a new class goes in, I geuss they offered her this position until then. I am not sure how it works with step raises being out 2 yrs on comp works but I would geuss that as long as she didnt have any break in employment which she didnt because the city was still paying weekly comp checks she should be brought up to the next 2 steps she missed. i know that they only thing she will not get is sick time and vacation accurred time while she was out. From what I read in my union book it said as long as you are not terminated, resign or are layed off for 12months injure time counts in step raises?

She needs to talk with her own union reps since each town can have ther own seniority rules.
Don't confuse departmental seniority with civil service seniority. Some departments start your seniority when hired, some whe you start the academy, some not until you graduate, and I am sure som even change it each time.
She should contact the applicable retirement board and check what group she has been classified as. If she was hired as a cop, and is considered out injured, then I would presume she is in group 4.
Always remember: your department, retirement system, civil service, and academy are all different entities, regulated by different rules and laws, and are many times at odds with each others mission.
