Hearing set for officer

One report said ‘jugular clamp’ used on inmate

CLINTON— A correction officer at the Worcester County House of Correction in West Boylston is due in court on allegations he struck a prisoner in October.

A criminal charge of assault and battery was filed against Kevin Lynch, 39, of Worcester, in connection with the allegations. That charge was dropped earlier this month, however, after his lawyer said the matter should have been heard by a clerk magistrate before a complaint was issued.

Such a hearing is scheduled for tomorrow in Clinton District Court, but defense lawyer Douglas I. Louison of Boston said in an interview yesterday he would be requesting a continuance to another date.

Mr. Lynch, described by Mr. Louison as a veteran officer with close to 10 years in the sheriff’s office, is accused of assaulting inmate William P. Jusseaume of Webster while the inmate was attempting to use a telephone inside the cell block. Mr. Jusseaume was allegedly grabbed by the throat with two hands and shaken, according to court documents.

During an internal investigation, the sheriff’s office came into possession of two reports in its Sheriff’s Information Resource System, also known as SIRS. Both reports were labeled as having been entered by Mr. Lynch, though only one report was saved into SIRS, according to court records.

One report described Mr. Lynch as using a “jugular clamp” to control Mr. Jusseaume, while the other report refers to the method of restraint as an arm placed across the inmate’s chest. The second report, describing the arm across the inmate’s chest, was entered into SIRS, while the version that described a “jugular clamp” was slid under the door of the operations captain by an unknown person, according to court records. That report was eventually turned over to investigators and staff at the jail.

Interviews of those present during the alleged assault corroborated Mr. Jusseaume’s allegation as well as the event described in the “jugular clamp” report, saying Mr. Lynch choked the inmate during the incident and that the use was not within the scope of reasonable force, according to court records.

After the internal investigation was completed, the case was presented to the Worcester district attorney’s office.

Mr. Louison said his client will fight the accusations.

“There was no chokehold involved,” he said, referring to the “jugular clamp.”

Mr. Lynch remains on paid administrative leave from the sheriff’s department, said Jeffrey A. Turco, deputy superintendent of the jail. Mr. Jusseaume remains in custody at the House of Correction.

The sheriff's office filed charges against their own officer for this?? WTF

Lets see the real picture how it really happened. The inmate was on the phone and it was lock down. The officer probably ordered him off the phone and into his cell and the inmate told him to screw. The officer then ,more then likely gave the inmate three more direct orders with no results and then attempted to escort the inmate hands on to his cell and this inmate resisted. Now if he left the inmate out after these orders other inmates would follow siute when they got out and the officer looses respect. The officer also dont know if this behavior is happening due to a weapon or a plan the inmate has to stay out and harm someone. But more than likely the inmate probably talked smack to the other inmates how he was not going to lock in or get off the phone and how he would kick the officers ass. The inmate lost and got laughed at and put in a fake law suite to save face. Gotta love these hard guys. What a rat this solid con is. Hmm that wont get him to far inside the clink.

There's a rat in the house and it is not the convict. The guy does a report and someone tells him maybe he should word it a little differently. He does and then some rat gets hold of the original report and slides it under the Captain's door.

I agree with 94c, someone is not to solid and is out to destroy officers lively hoods. But I wonder if they have cameras where that report was passed in. They really should make shore nobody else added a few lines to his report. Then again they should see why this guy was in possession this report in the first place. Bet you they dont because he's with no question a real company man. He can see those stripes now. Welcome to the world of corruptions,oops!! I meant corrections.

some officers side with the inmates because their scared. these gutless wonders write false reports against fellow officers to appease the inmates and the administration.

inmates are happy because these bogus reports give them power over the officers that do their job , management is happy because this sort of travesty helps them cultivate inmate informants and the worthless excuse of a CO gets a promotion and a desk job , thus removing him from all the scary convicts.

the officer turned fiction writer and inmate sympathizer is the same animal as the adminstration , both are spineless

To "appease the inmates and administration." Is this some crazy theory? Never heard of false reports being filed for inmates & the administration. Corrections must really be fucked up since I left!

most officers are hard working and decent .it's a hard job , but they do their best

however , we do have individuals that won't leave because they like the money and benefits. usually they become consolers or find a place away from the convicts.

unfortunately management will throw them inside to watch them sweat. in a desperate effort to appease their handlers ( management) they will do whatever is necessary to get out of the prison , including writing up fellow officers. their excuse is " i have a family to support"

they serve a purpose for the brass and remain in our ranks
