90/12 Criminal or civil?

I'm a bit rusty. Is allowing unlicensed operation still a criminal offense or has it been changed to a civil violation. I was told by another officer that it is no longer criminal but is now a $500 hundred dollar fine.Any input would be appreciated. I have a steak dinner at the Hilltop riding on this!!!!!

The only part that is the $500 fine is if you HIRE someone who is unlicensed.
Otherwise it was made criminal with the passing of Melanie's Law.

Chapter 90: Section 12. Employing or allowing unlicensed operator to operate motor vehicle

Section 12. No person shall employ for hire as an operator any person not licensed in accordance with this chapter. No person shall allow a motor vehicle owned by him or under his control to be operated by any person who has no legal right so to do, or in violation of this chapter.

I know what it's like to look up the wrong statue. Once I was at the Lincoln Memorial but thought it was the Statue of Liberty.

according to schefts legal inservice updates 2006-2007:

employing: 1st offense cmvi $500, 2nd offense 1 year house and/or $1000
fine

permitting unlicensed/suspended or interlock restriction: 1st offense 1 year
house and $500 fine, 2nd offense 2 1/2 years house and $1000
citation and crimial complaint issued

Can't you just feel the love in this thread? 94c may be right, but that does not give him license to "act the anus". No, 94c, not everyone is "up-to-speed" on chapter 90 as some of us do not use it on a regular basis. Too, some folks here have a life and it is not called "the job".

A polite statement regarding the current state of the law would have been sufficient and welcome. Personal attacks are unnecessary. Period.

Well thats close but not nessesarly exact. I'm sure most of us have taken many tests and worked in different places to gain experience, so i'm not sure where your going with it. I have worked and tested in other places as well, so what.

First of all this battle goes back quite a bit with this butt holes personal attacks. I'm just returning the favor. Unless your here as his back-up stay out of it.

I'm the first to help someone out. But when you start with the attacks and name calling then be prepared to get it back.

Maybe you will be a real cop someday until then just stick to what you know, courtest rides, locking/unlocking doors, and of course don't forget those DETEX rounds.
