Question on 90/8 Jr. Operator

Question came up tonight on Jr. Operator time restriction between 12 and 5. If someone has been found responsible once before for violating the restriction. When their license is re-issued by RMV does the 6 months of restriction start over again starting from the date of reissue?

Is it still 12-5?...i stopped a kid and his license said between 12 and 5 but it was issued a year ago and my 2006 MV law says between 1 and 4...so i let that 35 bucks go and just hit him with the 57 in a 30

The 6 month passenger restriction continues where it left off after the license gets re-instated. I've been citing for thr 12-5 restriction since I got on, and havent heard anything to the contrary from the RMV or Courts.

The time restriction is 12-5 (secondary offense), but it is a primary offense from 1-5. They don't want kids driving like fools trying to beat the midnight hour.

It's primary between 1am - 4 am. Secondary between 12am-1am and 4am-5am.

If they drive like fools between 12-1 you can stop them for an infraction, plus the Jr. operator violation. So the answer in a perfect world would be, no.

I was just being difficult
Kids will be kids.. they need to be home at 9? They'll leave at 859. 12? 1159. 1? 1259.

Whenever I stop for 90-17 and see a JOL, I use a lot of descretion and usually I am lenient. A lot of times I'll describe some of my experience with kids who speed and hope it sinks in. And if they are speeding to get home before a certain time, well I just made them late.. oops.

I dont understand the RMV's "logic" of why 12-5 is a the magic period. If they are not good at driveing, they are not good at driveing---wether it be 930 am, 147 pm, 1023 pm or 1 am.

Same with motorcycles, I dont understand the after dark restrictions on my permit. The passenger one I can see, but I opertate the bike just as good after dark as I do in the day light.

Sorry.........I'll get off my rant.

The last time I was lenient with a JOL I ended up with five roadside lawyers...which turned into a station full of cry babies!

Or you can just arrest them for operating outside their license restriction or issue them a CMVI for violation of G.L. c.90, s.8 which is a $35 fine and they loose their driving privileges for 30 days 1st offense, 60 days 2nd offense, 90 days for 3rd offense. And the remainder of the 6 month restriction period runs after suspension ends.

it's not necessarily that they drive worse after 1am or midnight...but more often than not a 17 year old kid out and about at 3am is up to no good. it's a governmental curfew...thats all

Maybe the common consensus is that 16 and 17 yr olds shouldn't be out after midnight in the first place?

And why not to the the RMV during the daylight and get your MC licence and be legit??

I complaint them as unlicensed. It's a license restriction violation. No properly licensed passenger in the car; it gets towed. Too bad, so sad.

I hate roadside lawyers. I really love when they come out with the "I go to ____ law school and I know the law and you can't do that".
