MGL governing "Improper Registration?"

A co-worker was reently mailed a ticket in his name for "improper registration." He lives in MA but had parked a car with NH plates in his driveway that evening.

The car belongs to his employer, who has has offices in both NH and MA; employs residents from both states; and has vehicles registered in both states. In NH light vehicles don't have Commercial plates, so it was not apparent that it was a company vehicle, although the registration is in the company name.

The company sometimes requires that a company vehicle be used for business for several days in a row. So it is somewhat common that a vehicle with NH tags could be parked for several evenings in a row in MA, or a vehicle with MA tags parked for several evenings in a row in NH.

Is there any protection for employees that are required to use a company car under these circumstances? The owner has proposed to attach a letter to each registration certificate as the vehicles could also be carrying a lot of computer or graphics equipment as well. The vehicles have special riders insuring the contents for $25,000.

What are the Mass laws that pertain to improper registration?

Was it from the RMV one of those "I pay tax" complaints or a regular Civil Motor Vehicle Citation?

It was a Uniform Citation written to the guy at his home address, although the car is registered to the company NH office. The MGL referenced is 90-3 1/2.

It's not his car, it's registered to a business, and they mailed HIM a ticket?

How would they know which person in the house to send the ticket to?

The officer who wrote the ticket stopped the guy previously. The Office Manager is trying to figure out what to do next.

Register it in Mass if the car is garaged there more then 50% of the time (meaning when it's parked, not hour/hour).

If it's a take-home company car, it needs to be registered in the state where it will be parked at night.

I had a company car for a little while, company was out of the mid-west. When I got the car, it had CT plates on it. I had to get a power-of-attorny from the vehicle owner (actualy a leasing company), and had it registered in Mass. For the registration, it had the owner as listed out of Texas (leasing company), and the leesee out of Ohio (my company). No Mass addresses were on the reg.

I still dont know why / how a person can be cited for this violation, as it's his company that is not in conformance with the law. It isn't your coworker's car, it's the company's...
