DCU Center official faces DUI charge

Driver allegedly hit cruiser on I-190

WORCESTER— The director of operations at the DCU Center was charged with drunken driving after he allegedly struck a state police cruiser with his car after the Oct. 25 Democratic rally at the center featuring former President Clinton.

Robert Hornbaker, 41, of 58 Brooks St., was charged with driving while under the influence of alcohol with a blood-alcohol level of 0.08 or higher, driving negligently so as to endanger, a marked lanes violation, speeding, failing to slow for highway workers, failing to use care in turning and failing to obey a police officer. The case was continued to Dec. 11 in Central District Court, according to court records. He was in court Monday for a pretrial conference.

Mr. Hornbaker was arrested after his car struck an occupied state police cruiser on the driver’s side shortly before 11:30 p.m. in a construction zone on Interstate 190 northbound, just north of Exit 1, according to a police report contained in the court file. Trooper Jay P. McGrath was taken to UMass Memorial Medical Center — University Campus as a result of hitting his head on the post of his cruiser when it was struck, according to the report.

Mr. Hornbaker, who allegedly did not pass field sobriety tests and a breath test administered at the scene, told police he had attended the political function at the DCU Center before the accident, the report states. Mr. Hornbaker’s lawyer, Christopher P. LoConto, said yesterday that his client’s car was struck by the cruiser, not the other way around. “No question. The photos show that, too,” Mr. LoConto said.

More than 8,000 people packed the DCU Center Oct. 25 when Mr. Clinton headlined a rally for the ticket of Deval L. Patrick and Mayor Timothy P. Murray, candidates for governor and lieutenant governor.
