how long can you leave a civil service department on military duty... i'm going back into the reserves and the unit i'm joining could send me away to numerous school totaling over a year, maybe close to two.... does your job have to give you the time away....i doubt they will pay but is my spot safe????

You are given 5 years under USERRA - that is the federal law and it trumps ALL city, state, contracts etc...

The five years can even be extended dependant on the circumstance.

If you have any other questions feel free to contact me directly - Ive been a reservist with multiple mobilizations and schools etc... I even had to file formal complaints with the US DOL about my employer (I won)

Your spot is safe - they have to give you a "similar job" with the same pay - basically if you are a police officer they can not make you work for the DPW.

However - a DPW truck driver could be made to be a truck driver for the water dept, or school dept. The good think about Police is there are no "similar" jobs

You should be fine. I've had two deployments in the past four years and have had no issues.

Did I read correctly; that your "going back in." ? I'm not sure if that affects your status but an employing agency would have to be pretty "f%#* up in todays climate to screw with anyone wanting in . That said, this is liberal-land; I'd check before I sign anything.

will it matter that i'm volunteering to go back in and choose a job that requires a lengthy training program.....anyone????

Nope. It doesn't matter if it is volunteer or compulsury. I know someone who left his job to go on active duty and kept extending... three years total... and I think at least a year of that was training... he came back to work a few months ago as if he never left. USERRA is wonderful.
