SSPO's and County SRT&Mutual Aid

Has anyone heard of F/T Campus SSPO's participating in a County Special Response Team? Is there a law saying they can or cannot? Also anyone work for or know of a mutual aid aggrement between a College PD and Local PD? Thanks-

The short answer is NO.


The long answer is NO the SSPO appointment only applies to their respective property, nowhere else. The Colonel can revoke said appointment anytime. The mutual aid law also specifically says: Section 8G. A city or town which accepts this section may enter into an agreement with another city or town, or other cities and towns including cities and towns in states contiguous to the commonwealth, to provide mutual aid programs for police departments . A school is not a city or town. I have never heard it proposed, except by you. I won't say your question is dumb but it is obviously moot. It would require many changes to laws extending their authority outside of their area.


CHAPTER 22C. THE DEPARTMENT OF STATE POLICE

Chapter 22C: Section 63. Employees of colleges, universities, other educational institutions and hospitals; appointment as special officers

Section 63. The colonel may, upon such reasonable terms and conditions as may be prescribed by him, at the request of an officer of a college, university, other educational institution or hospital licensed pursuant to section fifty-one of chapter one hundred and eleven, appoint employees of such college, university, other educational institution or hospital as special state police officers. Such special state police officers shall serve for three years, subject to removal by the colonel, and they shall have the same power to make arrests as regular police officers for any criminal offense committed in or upon lands or structures owned, used or occupied by such college, university, or other institution or hospital.

The question is not stupid at all. U-Mass Amherst has been allowed to enter into mutual aid agreements with Hadley and Amherst as I understand it. If anyone on this board is from U-Mass they may have better details on the question posted. I also know for a fact that they work with the Hampshire/Franklin County Drug Task Force.

YES!!!!!!

State schools have governmental powers by statute. U/Mass Amherst does have special statute (Section 2 of Chapter 348 of the Massachusetts General laws)which allowed them to enter into mutual aid with Hadley and Amherst.


Massasoit and East Bridgewater has formal written agreement for details, and in practice, does back up Brockton/Whitman/EB upon request (transferred authority) Also we have served our own arrest warrants recently as well, of course we DON'T do this as SSPO's, we are appointed by the trustees under 15A/s.22 and 73/s.18

Are you or your agency looking to participate in any specific response team, or any such multijurisdictional task forces?

I cannot quote any specific laws under MGL, nor do I have any specific examples, but if it is a county SRT, than logic would lead me to think that any Campus Police Agency that are duly sworn as deputies, should be able to get around jurisdictional issues associated SSPO limitations.

209, New Guy is right. If you are sworn in as a Deputy through your county than you could participate in multijurisdictional task forces without entering into a mutual aid agreement. You would be simply assisting other agencies within your jurisdiction of the county where your are appointed.

Chapter 348 of the Acts of 2004

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

SECTION 1. Section 1 of chapter 269 of the General Laws, as appearing in the 2002 Official Edition, is hereby amended by adding the following sentence:- For the purposes of this section, the University of Massachusetts at Amherst shall be considered to be a town.
SECTION 2...."

Section 2 goes on to state that they may enter into mutual aid agreements with Amherst, as well as other cities and towns....
