I figured I would give it another try...so I start profiling, that's right...profiling. I run a few plates and come up with a revoked. I make the stop and find a loaded 9 under the drivers feet. Gun comes up stolen from Atlanta PD. Nice clean pinch right? Judge says, "Why did you run the plate in the first place?" I answered, "I just ran it!" Judge says, "Well officer, you'd better never "just" run my plate!" Judge throws it out for bad stop. 22 year old Ada. appeals and teaches judge the law. Judge gives the sp probation because of my bad tactics {Profiling, randomly running plates etc}. I leave court, run the judges plate...and go back to my shade tree. |

Case law, there is NO right to privacy on your M/V plate, it is RMV property. You can run anyone you want. It's too bad a cop knows that and a Judge doesn't.

Chief Scott is attempting to have the people amend the Massachusetts’ Constitution requiring judges to be certified by the people every six years. He is basing his efforts on Article V and VII of the Commonwealth’s Constitution, the outrages perpetrated by judges he has personally witnessed and those brought to his attention by others in trying to make Massachusetts’ judges accountable to the people. It is the Chief’s belief that judges in the Commonwealth are not accountable to anyone, let alone the people. They are appointed for life and on numerous occasions make extremely liberal decisions that negatively impact the lives and safety of the citizens of the Commonwealth. Under the amendment proposed by Chief Scott, judges will continue to be appointed by the Governor and certified by the Governor’s Council. However, after six years and every six years thereafter they must be certified in an election by the citizens of Massachusetts. Please download a copy of the petition contained herein, get twenty signatures of registered voters and mail the signed petition to Chief Scott by the middle of February 2003. The Chief will utilize the signed petition as evidence, when he testifies before the Joint House/Senate Committee on the Judiciary, that citizens of the Commonwealth want judges accountable to them. |
