I just had an OUI today, refusal with out of state license (NH). We hand another one from VT couple of weeks ago. We enter them in LEAPS for refusal and they get an A number with a suspension but can you take their out of state license or do we notify the DMV from the other state or the RMV will. The guy from VT that was arrested a few weeks ago is suspended in MA but his VT license is still valid.

Within a few weeks, the NDR will notify the VT, or in this case, the NH registry which will suspend his license in his home state.

You cannot take their out of state license, nor do you issue a temp license. They do receive their notice of suspension however and their right to operate gets suspended in the Commonwealth. NDR is supposed to take care of the rest.

Thanks, I have seen NDR on MAss KQ. I wonder if they have an active MA license and a NDR Suspension out of state, is their right to operate here suspended as well. Thanks for the other info!

If they come up as active in Mass, they can drive regardless of what another state may say. If they come up active under one number but suspended in MA under another, the suspension wins out. If there's no status in Mass but suspended elsewhere they're unlicensed, if they have no status in MA, are active in state #2 and suspended in state #3, they can drive under the reciprocity of state #2.
