Hypothetical

I work with a girl whom I heard recently got her license suspended. The problem is she's still driving her car. Actually, the car isn't even registered in her name. She "bought" the vehicle from another co-worker. This co-worker now lives in California and sold the car to her before she moved. Unfortunately, this co-worker forgot to take her plates when she sold the car. So now, my co-worker is driving a vehicle around lincoln and smithfield with no license, no insurance and no legal attachment to the vehicle. The girl that moved to California has no idea this is going on. I am only assuming that if my co-worker were driving around in this car and were to get in an accident, the actual owner of the vehicle would be responsible for the damage. I am not sure if that is accurate. I really don't think that woudl be fair to her.

So what is your hypothetical question?

If my co-worker, whose license is suspended, were to get in an accident, would the girl that moved to California be responsible for any damange since the car is still legally registered in her name?

it depends... if the car is still registered to the woman in california, then yes, they will go after
her insurance company since the operator obviously doesn't have one. if the car is not registered to anybody (probably the case because i would think she would have been smart enough to cancel her registration) then the operator is screwed and the former owner is in the clear.

Thats what I figured. Well if the girl was dumb enough to leave the plates, I doubt she cancelled the registration. What would happen to my co-worker who would be driving with her license suspended, uninsured and the car registered in someone elses name? Are they going to hold her til they can prove why she's in the vehicle? What types of fines or charges would she be looking at?

operating after suspension
operating unregisterd/uninsured
attaching plates
they can run the VIN on the vehicle to prove she is the owner. it's up to the judge what the fines will be.. most likely a first offense in a case like this would be continued without a finding... meaning if she stays out of trouble for a few months it will go away.. also she will lose her license for at least 3 months.

and this in massachusetts. RI motor vehicle law could be a lot different...

and oh yeah she deserve's the moron of the week award.

Oh I agree. She already got in an accident with no car insurance.. Her license was suspeded for three months because of that. Now she's driving around with no license. The thing is, if they run the VIN, the car won't come back to her. It will come back to that girl that lives in California. I was wondering how that answer would fly with you guys. Kind of hard to prove you belong in a vehicle when the car isn't registered in your name, you have no license and the owner is on the other side of the country. I am trying to get as much information so I can smack her over the head with it ASAP.
